第一章 總則  

第(di)一條 為(wei)了完善勞(lao)動合同制(zhi)度,明確勞(lao)動合同雙方當(dang)事人的權利(li)和(he)義務,保護勞(lao)動者(zhe)的合法(fa)權益,構建和(he)發展(zhan)和(he)諧穩定的勞(lao)動關系,制(zhi)定本法(fa)。  

第二條 中華人(ren)民共和國境內的企業、個體經濟(ji)組織、民辦非企業單位等組織(以下稱用(yong)人(ren)單位)與勞(lao)動(dong)者建立(li)勞(lao)動(dong)關系,訂立(li)、履(lv)行、變更、解除或者終止勞(lao)動(dong)合同(tong),適用(yong)本法。  

國家機關、事業(ye)單位、社會團體和(he)與(yu)其建立(li)勞(lao)動關系的(de)勞(lao)動者,訂(ding)立(li)、履行、變更、解(jie)除或(huo)者終止(zhi)勞(lao)動合同,依照本法執(zhi)行。  

第三(san)條(tiao) 訂立勞動合同(tong),應當(dang)遵循合法(fa)、公(gong)平(ping)(ping)、平(ping)(ping)等自愿、協(xie)商一致、誠實信用的原則。  

依法訂立的勞(lao)動合(he)同(tong)具有約束力,用人單位與勞(lao)動者應當履行勞(lao)動合(he)同(tong)約定的義務。  

第四條(tiao) 用人(ren)單(dan)位應當依法建立和(he)完善勞(lao)(lao)動(dong)規章制(zhi)度,保障勞(lao)(lao)動(dong)者享(xiang)有勞(lao)(lao)動(dong)權利、履行勞(lao)(lao)動(dong)義務。  

用人(ren)單(dan)位在制定、修改或(huo)者決定有關(guan)勞(lao)(lao)(lao)動報酬、工作時(shi)間(jian)、休息(xi)休假、勞(lao)(lao)(lao)動安全(quan)衛生、保險(xian)福利、職工培訓(xun)、勞(lao)(lao)(lao)動紀律以及勞(lao)(lao)(lao)動定額管理等直接涉(she)及勞(lao)(lao)(lao)動者切身利益的規章制度或(huo)者重大事項時(shi),應當(dang)經(jing)職工代表(biao)大會或(huo)者全(quan)體職工討(tao)論,提(ti)出方案和(he)意(yi)見(jian),與工會或(huo)者職工代表(biao)平等協(xie)商確定。  

在(zai)規章制度和重大事項決定實施過程中,工(gong)會(hui)或者職工(gong)認為(wei)不適當的,有權向用(yong)人(ren)單(dan)位提出(chu),通過協商(shang)予(yu)以修改完善(shan)。  

用人單位(wei)應當(dang)將(jiang)直接(jie)涉及勞動(dong)者切(qie)身利(li)益的規(gui)章(zhang)制度和重大事項決定公示,或者告(gao)知勞動(dong)者。  

第(di)五(wu)條 縣級(ji)以上人民(min)政府勞(lao)動(dong)行政部(bu)門會(hui)同工會(hui)和企業方面代表,建立健全協調勞(lao)動(dong)關系三(san)方機制,共同研究解決有關勞(lao)動(dong)關系的重大問題(ti)。  

第六(liu)條 工會應當幫助、指導勞(lao)動(dong)者(zhe)與用人單位依(yi)法訂立(li)和履行勞(lao)動(dong)合(he)同,并與用人單位建立(li)集(ji)體(ti)協商機制,維護勞(lao)動(dong)者(zhe)的合(he)法權(quan)益。  

第二章(zhang) 勞動(dong)合同的訂立  

第七條 用人單(dan)位自用工之(zhi)日起即與勞動者建(jian)立(li)勞動關系。用人單(dan)位應當(dang)建(jian)立(li)職(zhi)工名冊備查。  

第八條 用人單位(wei)招用勞動(dong)(dong)者(zhe)時,應當如實(shi)告知勞動(dong)(dong)者(zhe)工(gong)作(zuo)內(nei)容、工(gong)作(zuo)條件(jian)、工(gong)作(zuo)地(di)點、職業危害、安全生產狀況(kuang)(kuang)、勞動(dong)(dong)報酬,以及(ji)勞動(dong)(dong)者(zhe)要求了解的其(qi)他情況(kuang)(kuang);用人單位(wei)有(you)權了解勞動(dong)(dong)者(zhe)與(yu)勞動(dong)(dong)合同直接相(xiang)關的基本情況(kuang)(kuang),勞動(dong)(dong)者(zhe)應當如實(shi)說(shuo)明。  

第九(jiu)條 用(yong)人單位(wei)招用(yong)勞(lao)動(dong)(dong)者,不得扣押勞(lao)動(dong)(dong)者的居民身份證和其(qi)他(ta)證件,不得要求勞(lao)動(dong)(dong)者提供(gong)擔保或者以其(qi)他(ta)名義向勞(lao)動(dong)(dong)者收取財(cai)物。  

第十條 建(jian)立勞動關系,應當訂立書面勞動合同。  

已建(jian)立勞(lao)動(dong)關系,未同(tong)時訂立書(shu)面勞(lao)動(dong)合(he)同(tong)的(de),應當自用工之(zhi)日起一個(ge)月內(nei)訂立書(shu)面勞(lao)動(dong)合(he)同(tong)。  

用人單(dan)位與勞動者(zhe)在用工前訂立勞動合同的,勞動關系(xi)自用工之日(ri)起建立。  

第十一條 用(yong)人(ren)單(dan)位(wei)未在用(yong)工(gong)(gong)的(de)(de)(de)同時訂立書面勞(lao)(lao)動(dong)合(he)(he)同,與勞(lao)(lao)動(dong)者(zhe)約(yue)定(ding)的(de)(de)(de)勞(lao)(lao)動(dong)報酬不明確的(de)(de)(de),新招(zhao)用(yong)的(de)(de)(de)勞(lao)(lao)動(dong)者(zhe)的(de)(de)(de)勞(lao)(lao)動(dong)報酬按照(zhao)集體合(he)(he)同規(gui)定(ding)的(de)(de)(de)標準(zhun)執(zhi)行;沒(mei)有集體合(he)(he)同或者(zhe)集體合(he)(he)同未規(gui)定(ding)的(de)(de)(de),實行同工(gong)(gong)同酬。  

第十二條 勞動合同(tong)(tong)(tong)分為固定(ding)期限(xian)勞動合同(tong)(tong)(tong)、無固定(ding)期限(xian)勞動合同(tong)(tong)(tong)和(he)以(yi)完成一定(ding)工作任務為期限(xian)的(de)勞動合同(tong)(tong)(tong)。  

第十三(san)條 固定(ding)期限勞(lao)動(dong)(dong)合同(tong),是指用人單位與(yu)勞(lao)動(dong)(dong)者約(yue)定(ding)合同(tong)終止(zhi)時(shi)間的勞(lao)動(dong)(dong)合同(tong)。  

用人單位與(yu)勞(lao)動(dong)(dong)者協商一致,可以訂立固定期限勞(lao)動(dong)(dong)合同。  

第(di)十四條 無固定期限勞(lao)動合同(tong),是指(zhi)用(yong)人單(dan)位與勞(lao)動者約定無確定終(zhong)止時間的勞(lao)動合同(tong)。  

用人單位(wei)與(yu)勞(lao)動(dong)者(zhe)協商一(yi)致,可以訂(ding)立(li)無固定期限(xian)勞(lao)動(dong)合(he)(he)同。有下(xia)列情形之一(yi),勞(lao)動(dong)者(zhe)提出或者(zhe)同意(yi)續訂(ding)、訂(ding)立(li)勞(lao)動(dong)合(he)(he)同的,除勞(lao)動(dong)者(zhe)提出訂(ding)立(li)固定期限(xian)勞(lao)動(dong)合(he)(he)同外,應當訂(ding)立(li)無固定期限(xian)勞(lao)動(dong)合(he)(he)同:  

(一(yi))勞動者(zhe)在(zai)該用人(ren)單(dan)位連續工作滿(man)十(shi)年(nian)的;  

(二)用人單位初次實行勞(lao)動(dong)合(he)同制度或者國有(you)企業(ye)改制重新訂立勞(lao)動(dong)合(he)同時,勞(lao)動(dong)者在該用人單位連(lian)續工作滿(man)十年(nian)且距法定(ding)退(tui)休年(nian)齡不足十年(nian)的;  

(三)連(lian)續訂(ding)立二(er)次固定期限(xian)勞(lao)動合同(tong),且(qie)勞(lao)動者沒有本(ben)法第(di)三十九(jiu)條和第(di)四十條第(di)一項(xiang)、第(di)二(er)項(xiang)規(gui)定的(de)情形(xing),續訂(ding)勞(lao)動合同(tong)的(de)。  

用人(ren)(ren)單位(wei)自用工之日(ri)起滿一年不(bu)與勞(lao)動者訂立書面勞(lao)動合(he)同的(de),視為用人(ren)(ren)單位(wei)與勞(lao)動者已訂立無(wu)固定期(qi)限勞(lao)動合(he)同。  

第十五條 以(yi)完成(cheng)一定(ding)工作任務(wu)為(wei)(wei)期限的勞(lao)動合(he)同,是指用人單位與勞(lao)動者約定(ding)以(yi)某項工作的完成(cheng)為(wei)(wei)合(he)同期限的勞(lao)動合(he)同。  

用人單位(wei)與勞動者(zhe)協(xie)商一致,可以(yi)訂立以(yi)完成一定工作任務為期限的勞動合同。  

第十(shi)六條 勞(lao)動合(he)同(tong)由用人單(dan)位與勞(lao)動者協商一致,并(bing)經用人單(dan)位與勞(lao)動者在勞(lao)動合(he)同(tong)文本上簽字或者蓋章生效。  

勞動合同(tong)文本(ben)由(you)用(yong)人(ren)單位和勞動者(zhe)各執一份。  

第十七條 勞動合(he)同應當(dang)具備以下條款:  

(一(yi))用(yong)人單位(wei)的名稱、住所和法定代表人或(huo)者主(zhu)要負責(ze)人;  

(二)勞動者的姓名、住址和居民身份證或(huo)者其(qi)他有效身份證件號(hao)碼(ma);  

(三)勞動合同期(qi)限;  

(四)工作內容和工作地點;  

(五)工(gong)作時(shi)間和休(xiu)息休(xiu)假;  

(六)勞動報(bao)酬;  

(七)社會(hui)保險;  

八)勞(lao)動保護(hu)、勞(lao)動條件和職業危(wei)害防護(hu);  

(九)法律、法規(gui)規(gui)定應當納入勞動合同(tong)的其他事項。  

勞(lao)動合(he)同(tong)除前款規定(ding)的必備(bei)條款外(wai),用人(ren)單位與勞(lao)動者可以(yi)約定(ding)試用期(qi)、培訓、保守(shou)秘密、補充保險和福(fu)利(li)待遇等其(qi)他(ta)事項。  

第十(shi)八條(tiao) 勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)對(dui)勞(lao)動(dong)(dong)(dong)報酬和(he)勞(lao)動(dong)(dong)(dong)條(tiao)件等(deng)標準約定(ding)(ding)不明確,引發爭議的,用(yong)人單位與勞(lao)動(dong)(dong)(dong)者(zhe)可(ke)以重新協(xie)商;協(xie)商不成(cheng)的,適用(yong)集(ji)體合(he)(he)同(tong)(tong)規(gui)(gui)定(ding)(ding);沒有集(ji)體合(he)(he)同(tong)(tong)或者(zhe)集(ji)體合(he)(he)同(tong)(tong)未規(gui)(gui)定(ding)(ding)勞(lao)動(dong)(dong)(dong)報酬的,實(shi)行同(tong)(tong)工同(tong)(tong)酬;沒有集(ji)體合(he)(he)同(tong)(tong)或者(zhe)集(ji)體合(he)(he)同(tong)(tong)未規(gui)(gui)定(ding)(ding)勞(lao)動(dong)(dong)(dong)條(tiao)件等(deng)標準的,適用(yong)國家有關規(gui)(gui)定(ding)(ding)。  

第十九條 勞動(dong)合同(tong)期限三個(ge)月以上不滿一(yi)年的,試用(yong)(yong)期不得(de)超(chao)過一(yi)個(ge)月;勞動(dong)合同(tong)期限一(yi)年以上不滿三年的,試用(yong)(yong)期不得(de)超(chao)過二(er)個(ge)月;三年以上固定期限和無固定期限的勞動(dong)合同(tong),試用(yong)(yong)期不得(de)超(chao)過六個(ge)月。  

同一用(yong)人單(dan)位與同一勞動者只能約定一次試用(yong)期。  

以完成一定工(gong)作(zuo)任務為期(qi)限的勞動(dong)合同或者勞動(dong)合同期(qi)限不滿(man)三個月(yue)的,不得約定試(shi)用期(qi)。  

試用(yong)期(qi)(qi)包含(han)在(zai)勞動(dong)合同期(qi)(qi)限內。勞動(dong)合同僅(jin)約定(ding)試用(yong)期(qi)(qi)的,試用(yong)期(qi)(qi)不成立,該期(qi)(qi)限為勞動(dong)合同期(qi)(qi)限。  

第二十(shi)(shi)條 勞(lao)動(dong)者(zhe)在(zai)試用期的工資不得低(di)(di)于(yu)本單位相同(tong)崗(gang)位最(zui)低(di)(di)檔(dang)工資或者(zhe)勞(lao)動(dong)合同(tong)約定工資的百(bai)分(fen)之(zhi)八(ba)十(shi)(shi),并不得低(di)(di)于(yu)用人(ren)單位所在(zai)地的最(zui)低(di)(di)工資標準。  

第二十一(yi)條 在(zai)試用(yong)期中,除勞(lao)動(dong)者(zhe)有本法第三十九條和第四十條第一(yi)項、第二項規定的情形(xing)外,用(yong)人單(dan)位不得解除勞(lao)動(dong)合同。用(yong)人單(dan)位在(zai)試用(yong)期解除勞(lao)動(dong)合同的,應當向(xiang)勞(lao)動(dong)者(zhe)說明理由。  

第二十二條 用人單位為勞(lao)動者(zhe)提供(gong)專項培訓費用,對其進(jin)行專業技術培訓的,可以與該勞(lao)動者(zhe)訂立協議,約(yue)定(ding)服務(wu)期。  

勞(lao)動者違(wei)(wei)反服務期約定(ding)(ding)的(de)(de),應當按照約定(ding)(ding)向用(yong)人單(dan)位支(zhi)(zhi)付(fu)違(wei)(wei)約金。違(wei)(wei)約金的(de)(de)數(shu)額(e)不(bu)得(de)超過用(yong)人單(dan)位提供的(de)(de)培訓費(fei)用(yong)。用(yong)人單(dan)位要求勞(lao)動者支(zhi)(zhi)付(fu)的(de)(de)違(wei)(wei)約金不(bu)得(de)超過服務期尚(shang)未履行部分所應分攤的(de)(de)培訓費(fei)用(yong)。  

用人單位(wei)與勞動(dong)者(zhe)約定服務(wu)期(qi)的(de),不影響按照正常(chang)的(de)工(gong)資調(diao)整機(ji)制(zhi)提高勞動(dong)者(zhe)在(zai)服務(wu)期(qi)期(qi)間的(de)勞動(dong)報酬。  

第(di)二十三條(tiao) 用人單(dan)位與(yu)勞動者可以(yi)在(zai)勞動合同中約定保守用人單(dan)位的商業秘(mi)密和與(yu)知識(shi)產(chan)權相關的保密事項。  

對負有保(bao)密義(yi)務的勞(lao)動(dong)者(zhe)(zhe),用(yong)人(ren)單位可(ke)以在勞(lao)動(dong)合同(tong)或(huo)者(zhe)(zhe)保(bao)密協議中與(yu)勞(lao)動(dong)者(zhe)(zhe)約(yue)定競業(ye)限(xian)制條(tiao)款,并約(yue)定在解(jie)除或(huo)者(zhe)(zhe)終止勞(lao)動(dong)合同(tong)后,在競業(ye)限(xian)制期限(xian)內按(an)月給予勞(lao)動(dong)者(zhe)(zhe)經濟補償。勞(lao)動(dong)者(zhe)(zhe)違反(fan)競業(ye)限(xian)制約(yue)定的,應當按(an)照(zhao)約(yue)定向用(yong)人(ren)單位支付違約(yue)金(jin)。  

第二十四(si)條 競業(ye)限(xian)制(zhi)的人員(yuan)限(xian)于用(yong)人單位(wei)的高級(ji)(ji)管理人員(yuan)、高級(ji)(ji)技術人員(yuan)和其他負有保密義務的人員(yuan)。競業(ye)限(xian)制(zhi)的范圍(wei)、地(di)域、期(qi)限(xian)由用(yong)人單位(wei)與勞動者(zhe)約(yue)定,競業(ye)限(xian)制(zhi)的約(yue)定不得違反法(fa)律(lv)、法(fa)規的規定。  

在解除或者(zhe)(zhe)(zhe)終止勞(lao)動合同(tong)后,前(qian)款規定的人(ren)員(yuan)到與本單(dan)位(wei)(wei)生產或者(zhe)(zhe)(zhe)經營同(tong)類(lei)產品、從事(shi)同(tong)類(lei)業(ye)務的有競(jing)爭關系的其他用(yong)人(ren)單(dan)位(wei)(wei),或者(zhe)(zhe)(zhe)自己開業(ye)生產或者(zhe)(zhe)(zhe)經營同(tong)類(lei)產品、從事(shi)同(tong)類(lei)業(ye)務的競(jing)業(ye)限制期限,不得(de)超過二(er)年。  

第(di)二(er)(er)十(shi)(shi)五條(tiao) 除本(ben)法第(di)二(er)(er)十(shi)(shi)二(er)(er)條(tiao)和第(di)二(er)(er)十(shi)(shi)三條(tiao)規定(ding)的情形外,用人單位不得(de)與勞(lao)動(dong)者約定(ding)由勞(lao)動(dong)者承擔(dan)違(wei)約金。  

第二十(shi)六條 下(xia)列勞動合同無效或者部分(fen)無效:  

(一)以欺詐、脅迫的手段或者乘(cheng)人之危,使對方在違(wei)背真實意思(si)的情況下訂立或者變更勞(lao)動合同(tong)的;  

(二)用人(ren)單(dan)位(wei)免除自己的法定責(ze)任、排除勞動者權利(li)的;  

(三)違反法(fa)律、行政法(fa)規強制(zhi)性規定的。  

對勞(lao)動(dong)合同的無效或者部分無效有爭議(yi)的,由勞(lao)動(dong)爭議(yi)仲裁機構或者人(ren)民法院確認(ren)。  

第二十七條(tiao) 勞(lao)動(dong)合(he)同部(bu)分(fen)無效(xiao),不(bu)影響其(qi)(qi)他部(bu)分(fen)效(xiao)力的(de),其(qi)(qi)他部(bu)分(fen)仍然有效(xiao)。  

第二十八條 勞(lao)(lao)(lao)動(dong)合同(tong)(tong)被確認無效(xiao),勞(lao)(lao)(lao)動(dong)者(zhe)已付出勞(lao)(lao)(lao)動(dong)的,用(yong)人單位(wei)(wei)應當向勞(lao)(lao)(lao)動(dong)者(zhe)支付勞(lao)(lao)(lao)動(dong)報酬。勞(lao)(lao)(lao)動(dong)報酬的數額(e),參照(zhao)本單位(wei)(wei)相同(tong)(tong)或(huo)者(zhe)相近崗位(wei)(wei)勞(lao)(lao)(lao)動(dong)者(zhe)的勞(lao)(lao)(lao)動(dong)報酬確定。  

第(di)(di)三章 勞動(dong)合同(tong)的履行(xing)和變更(geng)  第(di)(di)二(er)十九(jiu)條 用人單位(wei)與勞動(dong)者應當按(an)照(zhao)勞動(dong)合同(tong)的約定,全面履行(xing)各自的義(yi)務。  

第三十(shi)條 用人單位應當(dang)按照勞動合同約定和國家(jia)規定,向勞動者及(ji)時足額支付勞動報(bao)酬。  

用人單位拖(tuo)欠或者(zhe)未足(zu)額支付勞動報酬的,勞動者(zhe)可以依法向(xiang)當(dang)(dang)地人民法院申請支付令(ling),人民法院應當(dang)(dang)依法發出支付令(ling)。  

第三十一條 用人單位(wei)應(ying)(ying)當嚴格執行勞(lao)動(dong)定額標準,不得強迫(po)(po)或者變相(xiang)強迫(po)(po)勞(lao)動(dong)者加班。用人單位(wei)安(an)排加班的,應(ying)(ying)當按照國(guo)家有(you)關(guan)規定向勞(lao)動(dong)者支付加班費(fei)。  

第(di)三(san)十二條 勞動者拒絕用人(ren)單(dan)位管(guan)理人(ren)員違章(zhang)指揮、強(qiang)令冒險作業的,不視為違反勞動合同(tong)。  

勞(lao)動(dong)者對危害生命安全和(he)身體(ti)健(jian)康的勞(lao)動(dong)條(tiao)件(jian),有權對用人單位(wei)提(ti)出批評(ping)、檢舉和(he)控告。  

第三十三條 用人單(dan)位變(bian)更名稱(cheng)、法定(ding)代表人、主要負責人或者投資人等事(shi)項(xiang),不影響勞動合同的履行。  

第三十四條 用人(ren)(ren)單位(wei)發生合(he)(he)并或者分(fen)立等情況,原勞(lao)動(dong)合(he)(he)同繼續有效,勞(lao)動(dong)合(he)(he)同由承(cheng)繼其(qi)權利和義務的用人(ren)(ren)單位(wei)繼續履行。  

第三十(shi)五(wu)條 用(yong)人單位(wei)與勞動(dong)者協商一致(zhi),可以變(bian)(bian)更勞動(dong)合(he)(he)同約定的內容。變(bian)(bian)更勞動(dong)合(he)(he)同,應當采用(yong)書面形式。  

變(bian)更后的(de)勞動合同文本由用人單位和勞動者各執一份。  

第四章-勞(lao)動合(he)同(tong)的解除和終(zhong)止  

第三(san)十六(liu)條 用人單位(wei)與勞(lao)動者(zhe)協商一致,可以解(jie)除勞(lao)動合同。  

第三十(shi)七條 勞動者提(ti)前三十(shi)日以(yi)(yi)書面形(xing)式通知(zhi)用(yong)人單位,可以(yi)(yi)解(jie)除勞動合(he)同(tong)。勞動者在試用(yong)期(qi)內提(ti)前三日通知(zhi)用(yong)人單位,可以(yi)(yi)解(jie)除勞動合(he)同(tong)。  

第(di)三十八條(tiao) 用人單位有(you)下列情形之一的,勞動者可以(yi)解除勞動合同:  

(一(yi))未按照勞動合同約定提供勞動保護或者勞動條件(jian)的;  

(二)未及時足(zu)額支付勞動報酬的;  

(三(san))未(wei)依(yi)法(fa)為勞動者繳納社會(hui)保險(xian)費的;  

(四)用(yong)人單(dan)位的(de)(de)規(gui)(gui)章(zhang)制度違反法律、法規(gui)(gui)的(de)(de)規(gui)(gui)定,損害勞動者(zhe)權益的(de)(de);  

(五)因本(ben)法第二十六條第一款(kuan)規(gui)定的情形致使勞動合同無效的;  

(六)法(fa)律、行政法(fa)規(gui)規(gui)定勞(lao)動者可以(yi)解除勞(lao)動合(he)同的其他情形。  

用(yong)人單位(wei)以(yi)暴力、威脅或(huo)者(zhe)非(fei)法限制人身自由(you)的手(shou)段(duan)強迫勞(lao)動(dong)者(zhe)勞(lao)動(dong)的,或(huo)者(zhe)用(yong)人單位(wei)違章指揮(hui)、強令冒險作業危及勞(lao)動(dong)者(zhe)人身安全的,勞(lao)動(dong)者(zhe)可以(yi)立即解除勞(lao)動(dong)合(he)同,不需(xu)事先告知用(yong)人單位(wei)。  

第三(san)十九條 勞動者(zhe)有下列情形之一的,用人(ren)單位(wei)可以(yi)解除(chu)勞動合同:  

(一)在試(shi)用期間被證(zheng)明不符合錄用條件的;  

(二)嚴重違反(fan)用(yong)人單(dan)位的(de)規章制度的(de);  

(三)嚴重失(shi)職,營私舞弊,給用人單位造成重大(da)損害(hai)的;  

四)勞動者同時與(yu)其他用人單(dan)位(wei)建立勞動關系,對(dui)完成(cheng)(cheng)本單(dan)位(wei)的(de)工作(zuo)任務(wu)造成(cheng)(cheng)嚴重影響,或者經用人單(dan)位(wei)提出,拒不改(gai)正(zheng)的(de);  

(五(wu))因(yin)本法(fa)第(di)二十六條第(di)一(yi)款(kuan)第(di)一(yi)項(xiang)規定的(de)情形致使勞動(dong)合同無效的(de);  

(六)被依法追究刑事責(ze)任的。  

第四十條(tiao) 有(you)下列情形之一(yi)的,用人(ren)單位提前(qian)三十日以書(shu)面形式通(tong)知勞動者本人(ren)或者額外支付(fu)勞動者一(yi)個(ge)月工資(zi)后,可以解(jie)除勞動合同:  

(一)勞動者(zhe)患(huan)病或者(zhe)非因工(gong)負(fu)傷,在規定的(de)(de)醫療(liao)期滿后(hou)不能從事原工(gong)作(zuo),也不能從事由用(yong)人單位另(ling)行安排(pai)的(de)(de)工(gong)作(zuo)的(de)(de);  

(二)勞動者不(bu)能勝任工作(zuo),經(jing)過培訓或者調整工作(zuo)崗位,仍不(bu)能勝任工作(zuo)的;  

(三)勞(lao)動合同(tong)訂(ding)立時所依據(ju)的客觀情況(kuang)發生重大變(bian)化(hua),致使勞(lao)動合同(tong)無法履行,經用人單位(wei)與勞(lao)動者協商,未能就變(bian)更勞(lao)動合同(tong)內容達成協議的。  

第(di)四十(shi)(shi)一條 有下(xia)列(lie)情(qing)(qing)形之(zhi)一,需要裁(cai)減人(ren)(ren)員(yuan)二(er)十(shi)(shi)人(ren)(ren)以上(shang)或(huo)者(zhe)裁(cai)減不足(zu)二(er)十(shi)(shi)人(ren)(ren)但占企業職工總數百分之(zhi)十(shi)(shi)以上(shang)的,用人(ren)(ren)單(dan)位(wei)提前三十(shi)(shi)日向工會(hui)(hui)或(huo)者(zhe)全體職工說明(ming)情(qing)(qing)況,聽取工會(hui)(hui)或(huo)者(zhe)職工的意見(jian)后(hou),裁(cai)減人(ren)(ren)員(yuan)方案(an)經(jing)向勞動行政部門(men)報告,可以裁(cai)減人(ren)(ren)員(yuan):  

(一(yi))依照企業(ye)破產法(fa)規(gui)定進行重整的;  

(二)生產經(jing)營(ying)發生嚴重困難的;  

(三)企業轉產、重大(da)技術革新或(huo)者經營方式(shi)調整,經變更勞動(dong)合同后,仍(reng)需裁減人員的;  

(四)其他因勞(lao)動合同訂(ding)立時(shi)所(suo)依據的(de)客觀經濟情況(kuang)發生重大變化,致(zhi)使勞(lao)動合同無法履(lv)行的(de)。  

裁減人員時,應當(dang)優先留用下(xia)列人員:  

(一(yi))與本單位訂立較長期限的(de)固定期限勞動合同(tong)的(de);  

(二(er))與本(ben)單位訂立無(wu)固定期(qi)限勞動(dong)合同的;  

(三)家庭(ting)無其(qi)他就業(ye)人(ren)員,有需要撫養(yang)的老人(ren)或者未(wei)成年人(ren)的。  

用(yong)人(ren)(ren)(ren)單(dan)位(wei)依(yi)照本條第一款規定裁(cai)減人(ren)(ren)(ren)員(yuan),在六(liu)個月內重新(xin)招用(yong)人(ren)(ren)(ren)員(yuan)的,應當通知(zhi)被裁(cai)減的人(ren)(ren)(ren)員(yuan),并(bing)在同(tong)等條件下優先招用(yong)被裁(cai)減的人(ren)(ren)(ren)員(yuan)。  

第(di)四十(shi)二條(tiao) 勞動者有(you)下列情形之一的(de),用人單位不得依照本法第(di)四十(shi)條(tiao)、第(di)四十(shi)一條(tiao)的(de)規定解除勞動合(he)同:  

(一)從事接觸職(zhi)業病危害作業的(de)(de)勞動者(zhe)未進行離崗(gang)前職(zhi)業健康(kang)檢(jian)查,或者(zhe)疑(yi)似職(zhi)業病病人在診斷或者(zhe)醫學觀察期(qi)間(jian)的(de)(de);  

(二(er))在本單位患職業病(bing)或者(zhe)因工負傷并被確認喪(sang)失(shi)或者(zhe)部分喪(sang)失(shi)勞動能力的;  

(三(san))患病或者非因工負傷,在規定的(de)醫療期內的(de);  

(四)女職工(gong)在孕期、產期、哺乳期的;  

(五)在本單(dan)位連續工作滿十五年,且距法定退(tui)休年齡不足(zu)五年的;  

(六)法律、行政(zheng)法規(gui)規(gui)定的(de)其他情形。  

第(di)四十三條 用人(ren)單(dan)(dan)位單(dan)(dan)方(fang)解除(chu)勞(lao)動(dong)合同,應當事先(xian)將理(li)(li)由通知工(gong)(gong)會(hui)(hui)(hui)。用人(ren)單(dan)(dan)位違反法律(lv)、行政法規(gui)規(gui)定或者(zhe)勞(lao)動(dong)合同約定的,工(gong)(gong)會(hui)(hui)(hui)有權要求(qiu)用人(ren)單(dan)(dan)位糾正。用人(ren)單(dan)(dan)位應當研(yan)究(jiu)工(gong)(gong)會(hui)(hui)(hui)的意見,并將處理(li)(li)結(jie)果書面通知工(gong)(gong)會(hui)(hui)(hui)。  

第四(si)(si)十四(si)(si)條 有下列情形(xing)之一的,勞動合同終(zhong)止:  

(一)勞動合同期滿的;  

(二)勞動者開(kai)始依法(fa)享受(shou)基(ji)本養老保險(xian)待遇的(de);  

(三)勞(lao)動者(zhe)(zhe)死(si)亡,或者(zhe)(zhe)被人(ren)民法院(yuan)宣告(gao)死(si)亡或者(zhe)(zhe)宣告(gao)失蹤的;  

(四)用人單位被依法宣(xuan)告破產的;  

(五)用人單(dan)位(wei)(wei)被吊銷營業(ye)執照、責令關閉、撤銷或者(zhe)用人單(dan)位(wei)(wei)決定提前解散的(de);  

(六)法律、行(xing)政(zheng)法規(gui)規(gui)定的(de)其他情形。  

第四十五條 勞(lao)動(dong)合同(tong)(tong)期滿,有本(ben)法第四十二條規(gui)定(ding)情形之一的(de)(de),勞(lao)動(dong)合同(tong)(tong)應當(dang)續延至相應的(de)(de)情形消(xiao)失(shi)時(shi)終止。但是,本(ben)法第四十二條第二項規(gui)定(ding)喪失(shi)或者部分喪失(shi)勞(lao)動(dong)能力勞(lao)動(dong)者的(de)(de)勞(lao)動(dong)合同(tong)(tong)的(de)(de)終止,按照(zhao)國家有關工傷保(bao)險的(de)(de)規(gui)定(ding)執行(xing)。  

第四(si)十六條 有下列情(qing)形之一的(de),用人單位應當向勞動者(zhe)支付經濟補償(chang):  

(一)勞動者(zhe)依照(zhao)本法第三十八(ba)條規定解(jie)除勞動合同的;  

(二)用人(ren)單位依(yi)照本法第三十六條規定向(xiang)勞動者(zhe)提出(chu)解除(chu)勞動合同并與勞動者(zhe)協(xie)商一致解除(chu)勞動合同的;  

(三)用人單位(wei)依照本法(fa)第四十(shi)條規定解除勞動(dong)合同的;  

(四)用人單(dan)位依照本法第(di)四十一(yi)條(tiao)第(di)一(yi)款規定解除勞動合同(tong)的;  

(五)除(chu)用(yong)人(ren)單位(wei)維持或者(zhe)(zhe)提高(gao)勞(lao)(lao)動合(he)同(tong)約定條件續(xu)訂勞(lao)(lao)動合(he)同(tong),勞(lao)(lao)動者(zhe)(zhe)不同(tong)意(yi)續(xu)訂的(de)情形外(wai),依照(zhao)本法第四(si)十(shi)四(si)條第一項規定終止固定期限勞(lao)(lao)動合(he)同(tong)的(de);  

(六)依照本(ben)法第四十四條(tiao)第四項、第五項規定終(zhong)止(zhi)勞(lao)動合同(tong)的(de);  

(七)法(fa)(fa)律、行政法(fa)(fa)規(gui)規(gui)定(ding)的其他(ta)情形(xing)。  

第四十七條 經(jing)濟補償(chang)按勞(lao)動者在本單位工(gong)作的(de)年(nian)(nian)限,每滿(man)一年(nian)(nian)支(zhi)付(fu)一個(ge)月(yue)工(gong)資的(de)標準(zhun)向勞(lao)動者支(zhi)付(fu)。六個(ge)月(yue)以上不滿(man)一年(nian)(nian)的(de),按一年(nian)(nian)計(ji)算;不滿(man)六個(ge)月(yue)的(de),向勞(lao)動者支(zhi)付(fu)半個(ge)月(yue)工(gong)資的(de)經(jing)濟補償(chang)。  

勞動者月(yue)工(gong)資高于用人(ren)單位所在直轄(xia)市、設區的(de)市級人(ren)民(min)政(zheng)府公布的(de)本地(di)區上(shang)年度職工(gong)月(yue)平(ping)均(jun)工(gong)資三倍的(de),向其(qi)支付(fu)(fu)經濟補償(chang)的(de)標準(zhun)按職工(gong)月(yue)平(ping)均(jun)工(gong)資三倍的(de)數額(e)支付(fu)(fu),向其(qi)支付(fu)(fu)經濟補償(chang)的(de)年限最高不(bu)超過(guo)十二年。  

本(ben)條所稱月(yue)工(gong)資(zi)(zi)是(shi)指勞動者(zhe)在勞動合同解除或者(zhe)終止前十(shi)二個月(yue)的(de)平均工(gong)資(zi)(zi)。  

第四十八(ba)條 用人(ren)(ren)單(dan)位(wei)違反本(ben)法(fa)規(gui)定(ding)解除或者(zhe)終止勞(lao)動(dong)合(he)同,勞(lao)動(dong)者(zhe)要(yao)求繼續(xu)履行(xing)勞(lao)動(dong)合(he)同的,用人(ren)(ren)單(dan)位(wei)應當(dang)繼續(xu)履行(xing);勞(lao)動(dong)者(zhe)不要(yao)求繼續(xu)履行(xing)勞(lao)動(dong)合(he)同或者(zhe)勞(lao)動(dong)合(he)同已經不能(neng)繼續(xu)履行(xing)的,用人(ren)(ren)單(dan)位(wei)應當(dang)依照本(ben)法(fa)第八(ba)十七(qi)條規(gui)定(ding)支(zhi)付賠償(chang)金(jin)。  

第四(si)十(shi)九條 國(guo)家采取(qu)措施,建立健全勞動者社(she)會保險關系跨地區轉移接續制度。  

第五(wu)十條 用(yong)人單(dan)位(wei)應當在(zai)解除或(huo)者終止勞(lao)動合同時(shi)出(chu)具解除或(huo)者終止勞(lao)動合同的(de)證明(ming),并在(zai)十五(wu)日內為勞(lao)動者辦理檔案和社(she)會(hui)保險關系(xi)轉移手續。  

勞動者應(ying)當(dang)(dang)按照(zhao)雙方約定(ding),辦理工作交接(jie)(jie)。用(yong)人單位(wei)依照(zhao)本法有(you)關規定(ding)應(ying)當(dang)(dang)向勞動者支(zhi)付經(jing)濟補(bu)償的(de),在(zai)辦結工作交接(jie)(jie)時支(zhi)付。  

用人單位對已經解(jie)除(chu)或者(zhe)終止的勞動合同(tong)的文本,至少保(bao)存二年備查。  

第(di)五(wu)章 特(te)別規定  

第(di)一節 集體(ti)合同(tong)  

第五十一條 企(qi)業職工(gong)(gong)一方(fang)與用(yong)人單位通過平(ping)等協(xie)商,可以就勞(lao)動(dong)報酬、工(gong)(gong)作時間、休(xiu)息休(xiu)假、勞(lao)動(dong)安全衛生(sheng)、保(bao)險(xian)福利等事項訂立集(ji)體合(he)同。集(ji)體合(he)同草(cao)案(an)應當提交職工(gong)(gong)代表(biao)大(da)會或者全體職工(gong)(gong)討論通過。  

集(ji)體合同(tong)由工(gong)會代(dai)表(biao)企業職工(gong)一方與用人(ren)單位訂(ding)立(li);尚未建立(li)工(gong)會的用人(ren)單位,由上級工(gong)會指導勞動(dong)者推舉的代(dai)表(biao)與用人(ren)單位訂(ding)立(li)。  

第五十二條(tiao) 企(qi)業職(zhi)工一方與用人單位可以訂立勞(lao)動安全衛生、女職(zhi)工權(quan)益保護、工資調整機制等專(zhuan)項集體合(he)同。  

第五十(shi)三條(tiao) 在縣(xian)級以(yi)下區域內,建筑業(ye)、采礦業(ye)、餐飲服(fu)務(wu)業(ye)等行業(ye)可(ke)以(yi)由工會(hui)與企業(ye)方(fang)面代表(biao)訂立行業(ye)性集(ji)體合同(tong)(tong),或者訂立區域性集(ji)體合同(tong)(tong)。  

第五十(shi)四條(tiao) 集體合同訂立后,應當報送勞(lao)動行(xing)政(zheng)部(bu)門(men);勞(lao)動行(xing)政(zheng)部(bu)門(men)自收(shou)到(dao)集體合同文本之日(ri)起十(shi)五日(ri)內未提出(chu)異議的,集體合同即(ji)行(xing)生效。  

依法訂立的集體(ti)合同(tong)對用人(ren)單(dan)位和勞動者(zhe)具(ju)有(you)約束力。行(xing)業(ye)性、區域(yu)性集體(ti)合同(tong)對當地本行(xing)業(ye)、本區域(yu)的用人(ren)單(dan)位和勞動者(zhe)具(ju)有(you)約束力。  

第五十五條 集體(ti)合(he)同中勞(lao)(lao)動(dong)(dong)報酬和勞(lao)(lao)動(dong)(dong)條件等標(biao)準(zhun)不得低于當(dang)地(di)人民政(zheng)府規定的(de)最低標(biao)準(zhun);用人單位與勞(lao)(lao)動(dong)(dong)者訂立(li)的(de)勞(lao)(lao)動(dong)(dong)合(he)同中勞(lao)(lao)動(dong)(dong)報酬和勞(lao)(lao)動(dong)(dong)條件等標(biao)準(zhun)不得低于集體(ti)合(he)同規定的(de)標(biao)準(zhun)。  

第五十六條 用(yong)人單位違反集體(ti)合同(tong),侵犯(fan)職(zhi)工(gong)(gong)勞動權益的,工(gong)(gong)會可(ke)以依(yi)(yi)法(fa)要求用(yong)人單位承(cheng)擔責任;因履行(xing)集體(ti)合同(tong)發生爭議,經協商解決不成的,工(gong)(gong)會可(ke)以依(yi)(yi)法(fa)申請仲裁、提起訴訟。

第二(er)節 勞務(wu)派(pai)遣  

第五十七條 經營勞務派遣業務應(ying)當具備下列條件:   

“(一)注冊資(zi)本不得(de)少于人民幣二百萬元(yuan);  

“(二)有與(yu)開展業務(wu)相適應的固定的經營場所和設施; 

“(三(san))有符合法律、行政法規規定的勞務派(pai)遣(qian)管理制度;  

“(四)法律、行政法規規定的其他條件。 

“經(jing)營勞務(wu)(wu)派遣業務(wu)(wu),應當向勞動行政部門(men)依(yi)法申請行政許(xu)可(ke);經(jing)許(xu)可(ke)的,依(yi)法辦(ban)理相應的公(gong)司登記。未經(jing)許(xu)可(ke),任何單位(wei)和個人不得經(jing)營勞務(wu)(wu)派遣業務(wu)(wu)。”  

第五十(shi)八(ba)條 勞務(wu)派(pai)遣(qian)單(dan)位(wei)(wei)是本法所稱用(yong)人(ren)單(dan)位(wei)(wei),應(ying)當(dang)(dang)履行用(yong)人(ren)單(dan)位(wei)(wei)對勞動者(zhe)(zhe)的(de)義務(wu)。勞務(wu)派(pai)遣(qian)單(dan)位(wei)(wei)與被派(pai)遣(qian)勞動者(zhe)(zhe)訂立的(de)勞動合同(tong),除應(ying)當(dang)(dang)載(zai)明(ming)本法第十(shi)七條規定的(de)事項外,還應(ying)當(dang)(dang)載(zai)明(ming)被派(pai)遣(qian)勞動者(zhe)(zhe)的(de)用(yong)工單(dan)位(wei)(wei)以及派(pai)遣(qian)期限(xian)、工作崗位(wei)(wei)等情況。  

勞(lao)務(wu)派遣單位應(ying)當(dang)(dang)與被派遣勞(lao)動(dong)者訂(ding)立二年(nian)以上的(de)固定(ding)期限勞(lao)動(dong)合同,按月(yue)支付勞(lao)動(dong)報(bao)酬(chou);被派遣勞(lao)動(dong)者在(zai)無(wu)工(gong)作期間,勞(lao)務(wu)派遣單位應(ying)當(dang)(dang)按照所在(zai)地人民政(zheng)府規定(ding)的(de)最低(di)工(gong)資標準,向其按月(yue)支付報(bao)酬(chou)。  

第(di)五十九條 勞(lao)務(wu)派(pai)遣(qian)單位(wei)(wei)派(pai)遣(qian)勞(lao)動(dong)者(zhe)應當與(yu)(yu)接受以(yi)勞(lao)務(wu)派(pai)遣(qian)形(xing)式(shi)用(yong)工的(de)單位(wei)(wei)(以(yi)下稱用(yong)工單位(wei)(wei))訂立(li)勞(lao)務(wu)派(pai)遣(qian)協議。勞(lao)務(wu)派(pai)遣(qian)協議應當約定派(pai)遣(qian)崗位(wei)(wei)和人(ren)員數量、派(pai)遣(qian)期(qi)限、勞(lao)動(dong)報酬和社會保險(xian)費的(de)數額(e)與(yu)(yu)支付方式(shi)以(yi)及違反協議的(de)責任。  

用工單(dan)位應(ying)當(dang)根據工作崗位的實際需要與勞務派(pai)遣(qian)(qian)單(dan)位確定(ding)派(pai)遣(qian)(qian)期限,不得(de)將連續用工期限分割訂立數個短期勞務派(pai)遣(qian)(qian)協議。  

第六十條 勞(lao)務派(pai)(pai)遣(qian)(qian)單位(wei)應(ying)當(dang)將勞(lao)務派(pai)(pai)遣(qian)(qian)協議的內容(rong)告知(zhi)被派(pai)(pai)遣(qian)(qian)勞(lao)動(dong)者。  

勞務派(pai)(pai)遣(qian)單(dan)位不得(de)克扣用工單(dan)位按照勞務派(pai)(pai)遣(qian)協議支付給被派(pai)(pai)遣(qian)勞動者的勞動報(bao)酬。  

勞(lao)務派遣單(dan)位和用工單(dan)位不得向被派遣勞(lao)動者(zhe)收取(qu)費用。  

第六十(shi)一條 勞(lao)(lao)務派(pai)遣(qian)單(dan)位跨地區派(pai)遣(qian)勞(lao)(lao)動(dong)(dong)者(zhe)的,被派(pai)遣(qian)勞(lao)(lao)動(dong)(dong)者(zhe)享有(you)的勞(lao)(lao)動(dong)(dong)報(bao)酬和勞(lao)(lao)動(dong)(dong)條件,按(an)照用工單(dan)位所在地的標準執行。  

第六十(shi)二(er)條 用工單位應當履(lv)行下列義(yi)務(wu):  

(一)執行國(guo)家(jia)勞(lao)(lao)動(dong)標準,提供相應的勞(lao)(lao)動(dong)條件(jian)和勞(lao)(lao)動(dong)保(bao)護;  

(二)告知(zhi)被派遣勞動者的(de)工作要(yao)求和勞動報(bao)酬  

(三(san))支付加班費、績效獎金,提(ti)供與(yu)工(gong)作崗(gang)位相(xiang)關的福利(li)待遇(yu);  

(四(si))對在崗被派遣勞(lao)動(dong)者進(jin)行(xing)工作崗位所(suo)必(bi)需的培訓(xun)  

(五)連續用(yong)工的,實行正(zheng)常的工資調整機(ji)制。  用(yong)工單位不得(de)將被派遣勞動者再派遣到其他(ta)用(yong)人單位。  

第六十三(san)條(tiao) 被派(pai)遣(qian)(qian)勞動(dong)者(zhe)(zhe)(zhe)享有(you)(you)與用(yong)(yong)工單(dan)(dan)位(wei)被派(pai)遣(qian)(qian)勞動(dong)者(zhe)(zhe)(zhe)享有(you)(you)與用(yong)(yong)工單(dan)(dan)位(wei)的(de)(de)(de)(de)勞動(dong)者(zhe)(zhe)(zhe)同工同酬的(de)(de)(de)(de)權(quan)利。用(yong)(yong)工單(dan)(dan)位(wei)應當按照同工同酬原則,對(dui)被派(pai)遣(qian)(qian)勞動(dong)者(zhe)(zhe)(zhe)與本單(dan)(dan)位(wei)同類(lei)崗位(wei)的(de)(de)(de)(de)勞動(dong)者(zhe)(zhe)(zhe)實行相(xiang)同的(de)(de)(de)(de)勞動(dong)報(bao)酬分配辦法。用(yong)(yong)工單(dan)(dan)位(wei)無同類(lei)崗位(wei)勞動(dong)者(zhe)(zhe)(zhe)的(de)(de)(de)(de),參照用(yong)(yong)工單(dan)(dan)位(wei)所在地(di)相(xiang)同或者(zhe)(zhe)(zhe)相(xiang)近(jin)崗位(wei)勞動(dong)者(zhe)(zhe)(zhe)的(de)(de)(de)(de)勞動(dong)報(bao)酬確定(ding)。  

“勞(lao)(lao)務派(pai)遣單位與被派(pai)遣勞(lao)(lao)動者(zhe)(zhe)訂(ding)立(li)的勞(lao)(lao)動合(he)同和(he)與用工單位訂(ding)立(li)的勞(lao)(lao)務派(pai)遣協議,載明或者(zhe)(zhe)約(yue)定(ding)的向被派(pai)遣勞(lao)(lao)動者(zhe)(zhe)支付的勞(lao)(lao)動報酬應當(dang)符合(he)前款(kuan)規定(ding)。”。  

第六(liu)十四條 被派(pai)遣(qian)勞(lao)動者(zhe)有權在勞(lao)務(wu)派(pai)遣(qian)單位或者(zhe)用工單位依法(fa)參加(jia)或者(zhe)組織工會,維護自(zi)身的合法(fa)權益。  

第(di)六十(shi)五條 被派遣(qian)勞(lao)動(dong)(dong)者可以依照(zhao)本法第(di)三十(shi)六條、第(di)三十(shi)八(ba)條的(de)規定與(yu)勞(lao)務派遣(qian)單位解除(chu)勞(lao)動(dong)(dong)合同。  

被派遣勞(lao)動者(zhe)有(you)本法第(di)(di)三十九條(tiao)和(he)第(di)(di)四十條(tiao)第(di)(di)一項、第(di)(di)二項規定(ding)情(qing)形的,用工(gong)單位可以(yi)將勞(lao)動者(zhe)退回勞(lao)務派遣單位,勞(lao)務派遣單位依照本法有(you)關規定(ding),可以(yi)與勞(lao)動者(zhe)解除勞(lao)動合同。  

第(di)六十(shi)六條 勞動合同用(yong)工(gong)(gong)是我國的企業基本用(yong)工(gong)(gong)形式。勞務派(pai)遣(qian)用(yong)工(gong)(gong)是補充(chong)形式,只能在(zai)臨時性(xing)、輔助性(xing)或者替代(dai)性(xing)的工(gong)(gong)作崗位上實(shi)施。  

“前款規(gui)定的(de)(de)臨時(shi)性工作(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)是指(zhi)存續時(shi)間不超(chao)過六個月的(de)(de)崗(gang)(gang)(gang)(gang)位(wei)(wei);輔(fu)助(zhu)性工作(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)是指(zhi)為主營業務崗(gang)(gang)(gang)(gang)位(wei)(wei)提供服務的(de)(de)非(fei)主營業務崗(gang)(gang)(gang)(gang)位(wei)(wei);替代(dai)性工作(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)是指(zhi)用工單位(wei)(wei)的(de)(de)勞動者因脫產學習、休假等原因無(wu)法工作(zuo)的(de)(de)一定期(qi)間內,可以(yi)由其他勞動者替代(dai)工作(zuo)的(de)(de)崗(gang)(gang)(gang)(gang)位(wei)(wei)。  

“用工(gong)單位應當嚴格控制勞務派(pai)遣用工(gong)數量,不得超過其用工(gong)總量的(de)一定比(bi)例,具(ju)體比(bi)例由國務院勞動(dong)行政部門規定。”。  

第六(liu)十七條 用(yong)人單(dan)位不(bu)得(de)設立勞務派(pai)遣單(dan)位向本單(dan)位或(huo)者所屬(shu)單(dan)位派(pai)遣勞動者。第三節 非全日制用(yong)工(gong)  

第六十八條(tiao) 非全日制(zhi)用(yong)工(gong)(gong),是指以小時(shi)(shi)計酬為主,勞動者在同一(yi)用(yong)人單位一(yi)般(ban)平均每(mei)日工(gong)(gong)作時(shi)(shi)間(jian)不超過(guo)(guo)四(si)小時(shi)(shi),每(mei)周(zhou)工(gong)(gong)作時(shi)(shi)間(jian)累計不超過(guo)(guo)二十四(si)小時(shi)(shi)的用(yong)工(gong)(gong)形式。  

第六十九條(tiao) 非全(quan)日(ri)制用工雙(shuang)方(fang)當事人可以訂立口頭協議。  

從(cong)事非(fei)全日制(zhi)用工的勞(lao)動(dong)(dong)者可以與一個(ge)或者一個(ge)以上用人單位訂(ding)(ding)(ding)立(li)(li)勞(lao)動(dong)(dong)合(he)(he)同;但是,后訂(ding)(ding)(ding)立(li)(li)的勞(lao)動(dong)(dong)合(he)(he)同不得影響先(xian)訂(ding)(ding)(ding)立(li)(li)的勞(lao)動(dong)(dong)合(he)(he)同的履(lv)行。  

第(di)七十條 非全日制用(yong)工雙方當事人不得約定試用(yong)期。  

第七十一(yi)條(tiao) 非全日制用(yong)工(gong)雙方(fang)(fang)當事人任何一(yi)方(fang)(fang)都可以隨時通知對(dui)方(fang)(fang)終止用(yong)工(gong)。終止用(yong)工(gong),用(yong)人單位不向勞動(dong)者支付經濟補償(chang)。  

第七(qi)十(shi)二條(tiao) 非全日制用工小時(shi)計酬標準不得(de)低于用人單位(wei)所在地人民政府(fu)規定的最(zui)低小時(shi)工資標準。  

非全日制(zhi)用工(gong)勞動報(bao)酬結算支付周期最(zui)長不得超過(guo)十五日。  

第六章 監督檢(jian)查  

第七十三條 國務院勞動行政部門負責全國勞動合同(tong)制度實施的監督管理。  

縣級以上地方人民政府勞(lao)動行政部(bu)門負責本行政區域內勞(lao)動合同(tong)制度實施的(de)監督管理(li)。  

縣級以上各(ge)級人民政府勞(lao)動行政部(bu)門(men)在(zai)勞(lao)動合同(tong)制度(du)實施的監督管(guan)理工(gong)作中,應(ying)當(dang)聽取工(gong)會(hui)、企(qi)業方(fang)面代表以及有關行業主管(guan)部(bu)門(men)的意見(jian)。  

第七十四條 縣級以上(shang)地方人民政(zheng)府勞(lao)動行(xing)(xing)政(zheng)部門依法(fa)對(dui)下(xia)列實施勞(lao)動合(he)同制(zhi)度的情況進行(xing)(xing)監督檢查:  

(一)用人單位制定直接涉及(ji)勞動者切身利(li)益的規章制度(du)及(ji)其執行的情(qing)況  

(二)用人單位與勞(lao)動者訂立和解(jie)除勞(lao)動合同的(de)情況;  

(三)勞務(wu)派(pai)遣單位(wei)和用工單位(wei)遵(zun)守(shou)勞務(wu)派(pai)遣有關(guan)規定的情況  

(四)用人單(dan)位遵(zun)守國家關于勞動者(zhe)工作時間(jian)和休(xiu)息(xi)休(xiu)假規定的情況;  

(五)用(yong)人(ren)單(dan)位支付勞(lao)動合同約(yue)定(ding)的勞(lao)動報酬(chou)和執行最低(di)工資(zi)標準的情(qing)況  

(六)用人單位參加各項社會保險和繳納社會保險費的情況;  

(七)法律、法規規定的其他勞動監察事項。  

第七十五條 縣級以上地方人民政(zheng)府勞(lao)動(dong)行政(zheng)部門實(shi)施監督(du)(du)檢查時,有(you)權查閱與(yu)勞(lao)動(dong)合(he)同、集體合(he)同有(you)關的材(cai)料,有(you)權對勞(lao)動(dong)場所進(jin)行實(shi)地檢查,用人單位和(he)勞(lao)動(dong)者都應(ying)當如實(shi)提供有(you)關情況和(he)材(cai)料。  勞(lao)動(dong)行政(zheng)部門的工(gong)作人員進(jin)行監督(du)(du)檢查,應(ying)當出示證件(jian),依法(fa)行使職權,文(wen)明(ming)執法(fa)。  

第七十六(liu)條 縣級以上人民政府建設、衛生、安全生產監督(du)(du)管理等有關主管部門在各自職責范圍內,對用人單位(wei)執行(xing)勞動(dong)合同(tong)制度的(de)情況進行(xing)監督(du)(du)管理。  

第七十七條 勞(lao)動(dong)者合法權益受到侵(qin)害(hai)的(de),有權要求有關部(bu)門依法處(chu)理(li),或者依法申請仲裁、提起(qi)訴訟。  

第七十(shi)八條 工(gong)會(hui)(hui)依(yi)法維護勞(lao)(lao)動者的合法權益,對用人單(dan)位履(lv)行勞(lao)(lao)動合同、集體合同的情況進行監(jian)督。用人單(dan)位違反勞(lao)(lao)動法律、法規和(he)勞(lao)(lao)動合同、集體合同的,工(gong)會(hui)(hui)有(you)權提(ti)出意見或(huo)者要求糾正;勞(lao)(lao)動者申請仲裁、提(ti)起訴訟的,工(gong)會(hui)(hui)依(yi)法給予支持(chi)和(he)幫助。  

第(di)七十(shi)九條(tiao) 任何(he)組織或(huo)者個人對(dui)違反本法(fa)的行為都(dou)有權舉報,縣(xian)級以(yi)上人民政(zheng)府勞動行政(zheng)部門應當及時核實、處(chu)理,并對(dui)舉報有功(gong)人員(yuan)給予獎勵。  

第七章 法(fa)律責任(ren)  

第(di)八十條 用人單位直接(jie)涉及勞動者切身(shen)利益的(de)規章制度違反法律(lv)、法規規定的(de),由勞動行政部門責(ze)令改正,給(gei)予警(jing)告(gao);給(gei)勞動者造成損害的(de),應當(dang)承擔賠償責(ze)任。  

第八十(shi)一條 用(yong)人單位提供的(de)勞(lao)(lao)(lao)動合同文本(ben)(ben)未載明本(ben)(ben)法規定(ding)的(de)勞(lao)(lao)(lao)動合同必備(bei)條款或者(zhe)用(yong)人單位未將勞(lao)(lao)(lao)動合同文本(ben)(ben)交付勞(lao)(lao)(lao)動者(zhe)的(de),由勞(lao)(lao)(lao)動行政部(bu)門責令改正(zheng);給勞(lao)(lao)(lao)動者(zhe)造(zao)成損(sun)害(hai)的(de),應當承擔賠償(chang)責任(ren)。  

第八十二(er)條(tiao) 用人單(dan)位自用工之日起超(chao)過一(yi)個月不滿一(yi)年未與勞(lao)動者訂立書面勞(lao)動合同的,應當向勞(lao)動者每月支付二(er)倍的工資。  

用人(ren)單(dan)位違反(fan)本法規定(ding)不與勞(lao)(lao)動者訂(ding)立無固定(ding)期(qi)限勞(lao)(lao)動合(he)同的,自應(ying)當訂(ding)立無固定(ding)期(qi)限勞(lao)(lao)動合(he)同之日(ri)起向勞(lao)(lao)動者每(mei)月支(zhi)付二(er)倍的工資。  

第八十三條 用人(ren)單位違反(fan)本法規定與勞(lao)動(dong)者約定試(shi)用期(qi)的,由勞(lao)動(dong)行政部門責令改正(zheng);違法約定的試(shi)用期(qi)已經履(lv)行的,由用人(ren)單位以(yi)勞(lao)動(dong)者試(shi)用期(qi)滿月工資為標準(zhun),按(an)已經履(lv)行的超過法定試(shi)用期(qi)的期(qi)間向勞(lao)動(dong)者支付賠償金。  

第八(ba)十(shi)四(si)條 用人(ren)單位(wei)違反本(ben)法規定(ding),扣押(ya)勞動者居民身份證等證件的,由(you)勞動行政(zheng)部門責令限期(qi)退還(huan)勞動者本(ben)人(ren),并依照有關法律規定(ding)給予處罰(fa)。  

用人(ren)單位(wei)違反本(ben)法規定(ding),以(yi)擔保或者(zhe)(zhe)其他名義向勞(lao)(lao)動(dong)者(zhe)(zhe)收取(qu)財物的,由勞(lao)(lao)動(dong)行政部門責(ze)令限期(qi)退還勞(lao)(lao)動(dong)者(zhe)(zhe)本(ben)人(ren),并以(yi)每人(ren)五百元以(yi)上二千(qian)元以(yi)下的標準處以(yi)罰款;給勞(lao)(lao)動(dong)者(zhe)(zhe)造成損(sun)害(hai)的,應當承擔賠償責(ze)任。  

勞動(dong)者依法解除或者終止勞動(dong)合同,用(yong)人單位扣押勞動(dong)者檔案或者其他物(wu)品(pin)的,依照前(qian)款規(gui)定(ding)處罰。  

第八十五條 用(yong)人(ren)(ren)單位(wei)(wei)有下列情形之一的,由勞動(dong)行政(zheng)部門責令(ling)限(xian)期支付(fu)(fu)勞動(dong)報酬、加班費(fei)或者經濟補償(chang);勞動(dong)報酬低(di)于當地(di)最(zui)低(di)工資標準(zhun)的,應當支付(fu)(fu)其差額(e)部分;逾期不(bu)支付(fu)(fu)的,責令(ling)用(yong)人(ren)(ren)單位(wei)(wei)按應付(fu)(fu)金(jin)額(e)百(bai)(bai)分之五十以上百(bai)(bai)分之一百(bai)(bai)以下的標準(zhun)向勞動(dong)者加付(fu)(fu)賠償(chang)金(jin):  

(一(yi))未(wei)按照勞(lao)動合同的(de)約定或者(zhe)(zhe)國家規定及時足額(e)支付(fu)勞(lao)動者(zhe)(zhe)勞(lao)動報酬(chou)的(de);  

(二)低于當地(di)最低工(gong)資標準支(zhi)付勞動者工(gong)資的  

三)安(an)排加(jia)班(ban)不支付加(jia)班(ban)費的(de);  

(四)解(jie)除或者(zhe)終止勞動(dong)合同,未依照本法(fa)規定向勞動(dong)者(zhe)支付經濟補償的。  

第八十六(liu)條 勞動合(he)同(tong)依照(zhao)本法第二(er)十六(liu)條規定被確認無效(xiao),給對(dui)方造成損(sun)害的(de),有過錯(cuo)的(de)一方應當承(cheng)擔賠償責任。  

第(di)八十七條 用(yong)人單位違反本(ben)法(fa)規定解(jie)除或者終止勞(lao)動(dong)(dong)合同的(de),應當依照(zhao)本(ben)法(fa)第(di)四(si)十七條規定的(de)經濟(ji)補(bu)償標準的(de)二倍向(xiang)勞(lao)動(dong)(dong)者支付賠(pei)償金。  

第八十八條 用人單位有下列情形之一的,依法給予(yu)行政處罰(fa);構成(cheng)犯罪的,依法追究(jiu)刑事責(ze)任;給勞動者(zhe)造成(cheng)損害的,應當承擔賠(pei)償責(ze)任:  

(一)以暴(bao)力、威(wei)脅或者(zhe)非法限制人(ren)身自(zi)由的(de)手段強迫勞動(dong)的(de)  

(二)違章指揮或者(zhe)(zhe)強令冒險作業危及(ji)勞(lao)動(dong)者(zhe)(zhe)人(ren)身安全的;  

(三)侮辱、體(ti)罰、毆打、非法搜查(cha)或者拘禁(jin)勞(lao)動者的(de)  

(四(si))勞(lao)動(dong)條件惡劣、環境污染嚴重,給勞(lao)動(dong)者身心健康造成嚴重損害的。  

第八(ba)十(shi)九條(tiao) 用人單位違反本法規定未向(xiang)勞(lao)動(dong)者(zhe)出具解(jie)除或(huo)者(zhe)終止勞(lao)動(dong)合同的書面證明,由勞(lao)動(dong)行(xing)政部門(men)責令改正;給勞(lao)動(dong)者(zhe)造成損害的,應當承(cheng)擔(dan)賠償責任。  

第九(jiu)十(shi)條 勞(lao)(lao)動(dong)者(zhe)(zhe)違(wei)反本法規定(ding)(ding)解除勞(lao)(lao)動(dong)合同(tong),或者(zhe)(zhe)違(wei)反勞(lao)(lao)動(dong)合同(tong)中(zhong)約定(ding)(ding)的保密(mi)義務或者(zhe)(zhe)競業限制,給用人單位造成(cheng)損失的,應當承擔賠償責任。  

第九十一條 用(yong)(yong)人單位(wei)招用(yong)(yong)與其他用(yong)(yong)人單位(wei)尚未解(jie)除或者(zhe)終止(zhi)勞動合(he)同的勞動者(zhe),給(gei)其他用(yong)(yong)人單位(wei)造(zao)成損(sun)失的,應當承擔連帶賠(pei)償責任。  

第九十二條(tiao) 違反本(ben)法(fa)(fa)規定,未(wei)經(jing)許可(ke),擅自經(jing)營勞務派遣業務的(de),由勞動(dong)行政部(bu)門責令停(ting)止(zhi)違法(fa)(fa)行為,沒收(shou)違法(fa)(fa)所得(de),并處違法(fa)(fa)所得(de)一倍以(yi)(yi)上五(wu)(wu)倍以(yi)(yi)下(xia)的(de)罰(fa)款;沒有(you)違法(fa)(fa)所得(de)的(de),可(ke)以(yi)(yi)處五(wu)(wu)萬元以(yi)(yi)下(xia)的(de)罰(fa)款。  

“勞(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)單(dan)位(wei)、用(yong)工單(dan)位(wei)違反本法有關勞(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)規定的(de),由勞(lao)動(dong)行政部(bu)門責(ze)令限期改正(zheng);逾期不(bu)改正(zheng)的(de),以(yi)(yi)每(mei)人五千元以(yi)(yi)上一(yi)萬元以(yi)(yi)下(xia)的(de)標準處以(yi)(yi)罰款(kuan),對勞(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)單(dan)位(wei),吊銷其(qi)勞(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)業務(wu)(wu)經營許可證。用(yong)工單(dan)位(wei)給被派(pai)(pai)遣(qian)(qian)(qian)勞(lao)動(dong)者造成損害的(de),勞(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)單(dan)位(wei)與用(yong)工單(dan)位(wei)承擔連(lian)帶賠(pei)償責(ze)任。”[4]。  

第九(jiu)十(shi)三條 對不具備(bei)合(he)法(fa)經營資格的(de)用人單位(wei)的(de)違法(fa)犯罪行為,依法(fa)追(zhui)究法(fa)律責任;勞(lao)動(dong)者(zhe)已經付出(chu)勞(lao)動(dong)的(de),該單位(wei)或者(zhe)其出(chu)資人應當(dang)依照本法(fa)有(you)關(guan)規定向勞(lao)動(dong)者(zhe)支付勞(lao)動(dong)報酬、經濟補償、賠償金;給勞(lao)動(dong)者(zhe)造(zao)成損害的(de),應當(dang)承擔賠償責任。  

第九十四(si)條 個(ge)人承(cheng)包(bao)經營違(wei)反本法規定招用(yong)勞動(dong)者,給勞動(dong)者造成損害的,發包(bao)的組織與(yu)個(ge)人承(cheng)包(bao)經營者承(cheng)擔連(lian)帶賠(pei)償(chang)責任。  

第九十五條 勞動行(xing)(xing)政部門(men)和其(qi)他有關主管部門(men)及其(qi)工作人(ren)員(yuan)玩忽(hu)職守、不(bu)履(lv)行(xing)(xing)法定(ding)職責,或(huo)者(zhe)(zhe)違法行(xing)(xing)使職權,給(gei)勞動者(zhe)(zhe)或(huo)者(zhe)(zhe)用人(ren)單位造(zao)成損害的(de),應當承擔賠償(chang)責任;對直(zhi)接負責的(de)主管人(ren)員(yuan)和其(qi)他直(zhi)接責任人(ren)員(yuan),依法給(gei)予行(xing)(xing)政處分;構成犯罪的(de),依法追究刑事責任。  

第八章 附則  

第九(jiu)十(shi)六(liu)條 事(shi)業單位與實行(xing)聘用(yong)制的工作人員(yuan)訂(ding)立、履行(xing)、變更、解除或者終止勞動合同,法律、行(xing)政法規(gui)或者國(guo)務院另有規(gui)定(ding)的,依照(zhao)其規(gui)定(ding);未作規(gui)定(ding)的,依照(zhao)本法有關規(gui)定(ding)執行(xing)。  

第九十七條(tiao) 本(ben)(ben)法(fa)(fa)施(shi)(shi)行前已(yi)依法(fa)(fa)訂立且在本(ben)(ben)法(fa)(fa)施(shi)(shi)行之日存續(xu)的(de)勞動合(he)(he)同(tong)(tong),繼續(xu)履行;本(ben)(ben)法(fa)(fa)第十四條(tiao)第二(er)款第三項規定連(lian)續(xu)訂立固定期(qi)(qi)限勞動合(he)(he)同(tong)(tong)的(de)次數,自(zi)本(ben)(ben)法(fa)(fa)施(shi)(shi)行后續(xu)訂固定期(qi)(qi)限勞動合(he)(he)同(tong)(tong)時開始計(ji)算。  

本(ben)法(fa)施行前已(yi)建立(li)勞動關系,尚未(wei)訂立(li)書面勞動合同的,應(ying)當自本(ben)法(fa)施行之日起一個(ge)月內(nei)訂立(li)。  

本(ben)法(fa)施(shi)行(xing)(xing)之(zhi)日存續的(de)勞(lao)動(dong)合同在本(ben)法(fa)施(shi)行(xing)(xing)后(hou)解除(chu)或者終止(zhi),依照本(ben)法(fa)第(di)四十(shi)六條規定(ding)(ding)(ding)應當(dang)支(zhi)付經(jing)濟補(bu)償的(de),經(jing)濟補(bu)償年(nian)限自(zi)本(ben)法(fa)施(shi)行(xing)(xing)之(zhi)日起計算;本(ben)法(fa)施(shi)行(xing)(xing)前按(an)照當(dang)時有關(guan)規定(ding)(ding)(ding),用人(ren)單位應當(dang)向勞(lao)動(dong)者支(zhi)付經(jing)濟補(bu)償的(de),按(an)照當(dang)時有關(guan)規定(ding)(ding)(ding)執行(xing)(xing)。第(di)九十(shi)八(ba)條 本(ben)法(fa)自(zi)2008年(nian)1月(yue)1日起施(shi)行(xing)(xing)。-說明:經(jing)過全國人(ren)民(min)代表大(da)會常務委(wei)員會于2012年(nian)12月(yue)28日通過第(di)一次修正后(hou)的(de)《中(zhong)華人(ren)民(min)共和國勞(lao)動(dong)合同法(fa)<2013年(nian)新修正版(ban)>》自(zi)2013年(nian)7月(yue)1日起施(shi)行(xing)(xing)。
