第一章 總(zong)則  

第一條 為了完善勞(lao)(lao)動合同(tong)(tong)制度(du),明確勞(lao)(lao)動合同(tong)(tong)雙方當事人的(de)(de)權利和(he)(he)義(yi)務,保護勞(lao)(lao)動者的(de)(de)合法權益(yi),構建和(he)(he)發展和(he)(he)諧穩定的(de)(de)勞(lao)(lao)動關系,制定本法。  

第二條 中華(hua)人民(min)共和(he)國境內(nei)的企業、個(ge)體(ti)經(jing)濟組織(zhi)、民(min)辦非企業單位等(deng)組織(zhi)(以下(xia)稱用(yong)人單位)與(yu)勞動者建立勞動關系,訂立、履行、變更、解除或者終(zhong)止(zhi)勞動合同,適用(yong)本(ben)法。  

國家機關、事業(ye)單位(wei)、社(she)會團體和與其建立勞(lao)動關系的(de)勞(lao)動者,訂(ding)立、履行、變更、解除(chu)或者終止勞(lao)動合同,依照本法(fa)執行。  

第三條(tiao) 訂立勞動合(he)同,應(ying)當遵(zun)循合(he)法、公平、平等(deng)自愿、協商一致、誠實信用的原則(ze)。  

依法訂立(li)的勞(lao)動(dong)合同具有約束力(li),用人單位(wei)與勞(lao)動(dong)者應當履(lv)行(xing)勞(lao)動(dong)合同約定的義務。  

第四條 用人單(dan)位應當(dang)依法建立和完(wan)善勞(lao)動(dong)規章(zhang)制度,保(bao)障(zhang)勞(lao)動(dong)者享有勞(lao)動(dong)權利、履行(xing)勞(lao)動(dong)義務。  

用(yong)人單位在制(zhi)定、修改或者決定有關勞(lao)動(dong)報酬、工作時間(jian)、休(xiu)息(xi)休(xiu)假、勞(lao)動(dong)安全衛生、保險福利、職工培訓、勞(lao)動(dong)紀律(lv)以及勞(lao)動(dong)定額管(guan)理等(deng)直接涉及勞(lao)動(dong)者切身利益的規章制(zhi)度或者重大事項(xiang)時,應(ying)當(dang)經職工代(dai)表大會(hui)或者全體職工討論,提出(chu)方案和意見,與工會(hui)或者職工代(dai)表平(ping)等(deng)協商確定。  

在規章制度(du)和(he)重大事(shi)項決定實施過(guo)程(cheng)中,工會或者職工認(ren)為不適當的,有權向(xiang)用人單位提出,通過(guo)協商予(yu)以修改完善。  

用人(ren)單(dan)位應當(dang)將直接(jie)涉及勞動者(zhe)切身(shen)利(li)益的規章制度(du)和重大(da)事(shi)項決定公示,或者(zhe)告知勞動者(zhe)。  

第(di)五(wu)條 縣(xian)級以上人民政府(fu)勞動(dong)行政部門會(hui)同(tong)工(gong)會(hui)和企業(ye)方(fang)(fang)面代表,建立健全協調(diao)勞動(dong)關(guan)系三方(fang)(fang)機制,共同(tong)研究解決(jue)有關(guan)勞動(dong)關(guan)系的重大問題。  

第六(liu)條 工會應當幫助、指(zhi)導勞動(dong)者與用人單(dan)位依法訂立和(he)履行勞動(dong)合(he)同,并與用人單(dan)位建(jian)立集體協商機制(zhi),維護(hu)勞動(dong)者的合(he)法權益(yi)。  

第二(er)章 勞動合(he)同的訂立(li)  

第七條 用人(ren)(ren)單位自用工之(zhi)日起即(ji)與(yu)勞動(dong)者建立(li)勞動(dong)關系(xi)。用人(ren)(ren)單位應當建立(li)職工名冊備查。  

第八條 用人(ren)單(dan)位(wei)招用勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)時(shi),應(ying)(ying)當(dang)(dang)如實告知勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)工作(zuo)內容、工作(zuo)條件、工作(zuo)地點、職(zhi)業危害、安全生產狀況(kuang)、勞(lao)動(dong)(dong)(dong)報酬,以及勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)要求了(le)解(jie)的其(qi)他情(qing)況(kuang);用人(ren)單(dan)位(wei)有權了(le)解(jie)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)與勞(lao)動(dong)(dong)(dong)合同直接(jie)相關的基本(ben)情(qing)況(kuang),勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)應(ying)(ying)當(dang)(dang)如實說明。  

第九(jiu)條(tiao) 用人(ren)單(dan)位(wei)招用勞動(dong)者,不(bu)得(de)扣押勞動(dong)者的居民身份(fen)證(zheng)和其他證(zheng)件,不(bu)得(de)要求勞動(dong)者提供擔保或者以其他名(ming)義(yi)向(xiang)勞動(dong)者收取(qu)財物。  

第十(shi)條 建立勞動關系,應(ying)當訂立書(shu)面(mian)勞動合(he)同。  

已(yi)建立勞(lao)動關(guan)系,未同(tong)(tong)時訂立書面(mian)勞(lao)動合同(tong)(tong)的(de),應當自用工之日起一個月內(nei)訂立書面(mian)勞(lao)動合同(tong)(tong)。  

用(yong)人單位與勞(lao)動(dong)者在用(yong)工前訂(ding)立(li)勞(lao)動(dong)合同的(de),勞(lao)動(dong)關系(xi)自用(yong)工之日起建立(li)。  

第(di)十一(yi)條 用人單位未(wei)在用工(gong)的(de)(de)同(tong)(tong)時訂立書面勞動(dong)(dong)(dong)合同(tong)(tong),與勞動(dong)(dong)(dong)者約定(ding)的(de)(de)勞動(dong)(dong)(dong)報酬(chou)不明(ming)確(que)的(de)(de),新招用的(de)(de)勞動(dong)(dong)(dong)者的(de)(de)勞動(dong)(dong)(dong)報酬(chou)按(an)照(zhao)集(ji)體(ti)合同(tong)(tong)規(gui)定(ding)的(de)(de)標(biao)準執行(xing);沒有集(ji)體(ti)合同(tong)(tong)或者集(ji)體(ti)合同(tong)(tong)未(wei)規(gui)定(ding)的(de)(de),實行(xing)同(tong)(tong)工(gong)同(tong)(tong)酬(chou)。  

第十(shi)二條 勞動(dong)合同分(fen)為固定(ding)期(qi)限(xian)勞動(dong)合同、無固定(ding)期(qi)限(xian)勞動(dong)合同和以完成一定(ding)工(gong)作任務為期(qi)限(xian)的(de)勞動(dong)合同。  

第(di)十三條 固定期(qi)限(xian)勞(lao)動(dong)合同,是指用(yong)人單位與勞(lao)動(dong)者約定合同終止時間(jian)的勞(lao)動(dong)合同。  

用人(ren)單位(wei)與勞動(dong)者協商一致,可以訂立固定(ding)期限勞動(dong)合(he)同。  

第(di)十四條 無(wu)固定(ding)(ding)期限(xian)勞(lao)動合(he)同(tong),是指用人單(dan)位與勞(lao)動者約定(ding)(ding)無(wu)確定(ding)(ding)終止時間(jian)的勞(lao)動合(he)同(tong)。  

用人單位與勞(lao)(lao)動(dong)者(zhe)協(xie)商一(yi)致,可以訂(ding)(ding)(ding)立(li)無固(gu)(gu)定期(qi)限(xian)(xian)勞(lao)(lao)動(dong)合(he)同(tong)(tong)。有(you)下列情形之一(yi),勞(lao)(lao)動(dong)者(zhe)提(ti)出(chu)或者(zhe)同(tong)(tong)意續訂(ding)(ding)(ding)、訂(ding)(ding)(ding)立(li)勞(lao)(lao)動(dong)合(he)同(tong)(tong)的,除勞(lao)(lao)動(dong)者(zhe)提(ti)出(chu)訂(ding)(ding)(ding)立(li)固(gu)(gu)定期(qi)限(xian)(xian)勞(lao)(lao)動(dong)合(he)同(tong)(tong)外,應當訂(ding)(ding)(ding)立(li)無固(gu)(gu)定期(qi)限(xian)(xian)勞(lao)(lao)動(dong)合(he)同(tong)(tong):  

(一)勞動(dong)者在該用人(ren)單位連續工作滿十年的;  

(二)用人單位初次實行勞(lao)(lao)動(dong)合同(tong)制度或(huo)者(zhe)(zhe)國有企(qi)業改制重新(xin)訂立勞(lao)(lao)動(dong)合同(tong)時(shi),勞(lao)(lao)動(dong)者(zhe)(zhe)在該用人單位連續工作滿十年且距(ju)法定退休(xiu)年齡不足十年的(de);  

(三(san)(san))連續訂(ding)立二(er)次固定期限(xian)勞(lao)動(dong)(dong)合(he)同,且勞(lao)動(dong)(dong)者沒有本法第三(san)(san)十(shi)九條和第四(si)十(shi)條第一(yi)項、第二(er)項規定的情形,續訂(ding)勞(lao)動(dong)(dong)合(he)同的。  

用人(ren)單(dan)位自用工之日起滿(man)一年不與(yu)勞動(dong)者訂(ding)立(li)書面勞動(dong)合同(tong)的,視為用人(ren)單(dan)位與(yu)勞動(dong)者已訂(ding)立(li)無固定期(qi)限勞動(dong)合同(tong)。  

第十五條(tiao) 以完(wan)(wan)成(cheng)一定工(gong)作(zuo)(zuo)任務為(wei)期限的(de)勞(lao)動合同(tong),是指用人(ren)單位與勞(lao)動者約定以某項(xiang)工(gong)作(zuo)(zuo)的(de)完(wan)(wan)成(cheng)為(wei)合同(tong)期限的(de)勞(lao)動合同(tong)。  

用(yong)人單位與勞動者(zhe)協商一致,可以訂立以完成一定工作任務為期(qi)限的勞動合(he)同。  

第十六條 勞(lao)動合同(tong)由(you)用人(ren)單位與(yu)勞(lao)動者(zhe)協商一致,并經用人(ren)單位與(yu)勞(lao)動者(zhe)在(zai)勞(lao)動合同(tong)文本(ben)上簽字或者(zhe)蓋章(zhang)生(sheng)效。  

勞動合同文本(ben)由用人(ren)單(dan)位和勞動者(zhe)各執一份。  

第十(shi)七條 勞(lao)動合同應當具(ju)備以下(xia)條款:  

(一)用人單位的名稱、住(zhu)所(suo)和法定代表人或者主要負責人;  

(二(er))勞動者(zhe)(zhe)的姓(xing)名、住(zhu)址和居民身份(fen)(fen)證(zheng)或者(zhe)(zhe)其他有(you)效身份(fen)(fen)證(zheng)件號碼;  

(三)勞動合(he)同期限;  

(四)工作內容和工作地點(dian);  

(五)工作時間(jian)和休息(xi)休假;  

(六)勞(lao)動報酬;  

(七(qi))社會保(bao)險;  

八)勞(lao)動(dong)保護、勞(lao)動(dong)條件和(he)職業危害防護;  

(九)法(fa)律、法(fa)規規定應(ying)當納入勞動(dong)合同的其他事項。  

勞動合(he)同除前款規定的必備條款外,用人單位與勞動者可以約定試用期、培(pei)訓(xun)、保守秘密、補(bu)充保險(xian)和福利待(dai)遇等其他事項(xiang)。  

第十八條(tiao) 勞(lao)動(dong)合(he)(he)同(tong)(tong)對勞(lao)動(dong)報酬(chou)(chou)和勞(lao)動(dong)條(tiao)件等標準約定不(bu)明(ming)確,引發爭(zheng)議(yi)的(de),用(yong)人單位(wei)與勞(lao)動(dong)者(zhe)可以重新協(xie)商;協(xie)商不(bu)成的(de),適用(yong)集(ji)體(ti)合(he)(he)同(tong)(tong)規(gui)(gui)定;沒有(you)(you)集(ji)體(ti)合(he)(he)同(tong)(tong)或者(zhe)集(ji)體(ti)合(he)(he)同(tong)(tong)未(wei)規(gui)(gui)定勞(lao)動(dong)報酬(chou)(chou)的(de),實行同(tong)(tong)工同(tong)(tong)酬(chou)(chou);沒有(you)(you)集(ji)體(ti)合(he)(he)同(tong)(tong)或者(zhe)集(ji)體(ti)合(he)(he)同(tong)(tong)未(wei)規(gui)(gui)定勞(lao)動(dong)條(tiao)件等標準的(de),適用(yong)國家(jia)有(you)(you)關(guan)規(gui)(gui)定。  

第十九條 勞動合同(tong)期(qi)(qi)限三個月以上(shang)不(bu)(bu)滿一(yi)年(nian)的(de),試(shi)用(yong)期(qi)(qi)不(bu)(bu)得超過(guo)一(yi)個月;勞動合同(tong)期(qi)(qi)限一(yi)年(nian)以上(shang)不(bu)(bu)滿三年(nian)的(de),試(shi)用(yong)期(qi)(qi)不(bu)(bu)得超過(guo)二個月;三年(nian)以上(shang)固(gu)定(ding)期(qi)(qi)限和無固(gu)定(ding)期(qi)(qi)限的(de)勞動合同(tong),試(shi)用(yong)期(qi)(qi)不(bu)(bu)得超過(guo)六個月。  

同一用(yong)人單(dan)位與同一勞動者(zhe)只能約定(ding)一次試(shi)用(yong)期。  

以(yi)完(wan)成一定工(gong)作任務為(wei)期(qi)限(xian)的(de)勞動合(he)(he)同(tong)或者(zhe)勞動合(he)(he)同(tong)期(qi)限(xian)不滿三(san)個月的(de),不得約定試用(yong)期(qi)。  

試用(yong)(yong)期包含在勞動合(he)同(tong)期限內。勞動合(he)同(tong)僅約定試用(yong)(yong)期的,試用(yong)(yong)期不成立,該期限為勞動合(he)同(tong)期限。  

第二十(shi)(shi)條 勞動(dong)者在(zai)試用(yong)期的(de)工(gong)資(zi)不得低(di)(di)(di)于本單位相(xiang)同崗(gang)位最低(di)(di)(di)檔工(gong)資(zi)或者勞動(dong)合同約定(ding)工(gong)資(zi)的(de)百分(fen)之八十(shi)(shi),并不得低(di)(di)(di)于用(yong)人單位所(suo)在(zai)地(di)的(de)最低(di)(di)(di)工(gong)資(zi)標準。  

第二(er)十一(yi)條 在試用(yong)期(qi)中,除(chu)勞(lao)(lao)動(dong)者(zhe)有本(ben)法第三十九(jiu)條和(he)第四十條第一(yi)項、第二(er)項規定的情形外,用(yong)人單位不得(de)解(jie)除(chu)勞(lao)(lao)動(dong)合同。用(yong)人單位在試用(yong)期(qi)解(jie)除(chu)勞(lao)(lao)動(dong)合同的,應當向勞(lao)(lao)動(dong)者(zhe)說(shuo)明理由。  

第二十二條 用(yong)(yong)人(ren)單(dan)位為(wei)勞動者(zhe)提供專項培訓(xun)費用(yong)(yong),對其進(jin)行專業技(ji)術培訓(xun)的,可(ke)以與該勞動者(zhe)訂立協(xie)議(yi),約定服(fu)務期。  

勞動者(zhe)違(wei)(wei)反服(fu)務期(qi)約定(ding)的(de),應(ying)當按(an)照約定(ding)向(xiang)用人(ren)(ren)單位(wei)支(zhi)付違(wei)(wei)約金(jin)。違(wei)(wei)約金(jin)的(de)數額(e)不(bu)得超過用人(ren)(ren)單位(wei)提(ti)供的(de)培訓(xun)費(fei)(fei)用。用人(ren)(ren)單位(wei)要求勞動者(zhe)支(zhi)付的(de)違(wei)(wei)約金(jin)不(bu)得超過服(fu)務期(qi)尚(shang)未(wei)履行(xing)部(bu)分所應(ying)分攤的(de)培訓(xun)費(fei)(fei)用。  

用人單位與勞動者(zhe)約定服務期(qi)的,不影響(xiang)按照正(zheng)常(chang)的工資調(diao)整(zheng)機(ji)制提高勞動者(zhe)在服務期(qi)期(qi)間的勞動報(bao)酬。  

第二十(shi)三條(tiao) 用人單位與(yu)勞動(dong)者可(ke)以在勞動(dong)合(he)同中(zhong)約定保(bao)守用人單位的商業秘密和與(yu)知(zhi)識產權相(xiang)關的保(bao)密事項(xiang)。  

對(dui)負有保(bao)密義務(wu)的勞(lao)動(dong)者(zhe),用人(ren)單位(wei)可以在勞(lao)動(dong)合同(tong)或者(zhe)保(bao)密協議中與(yu)勞(lao)動(dong)者(zhe)約定競(jing)業限制條(tiao)款,并約定在解除或者(zhe)終止勞(lao)動(dong)合同(tong)后,在競(jing)業限制期限內(nei)按月給予勞(lao)動(dong)者(zhe)經濟補償。勞(lao)動(dong)者(zhe)違反競(jing)業限制約定的,應當(dang)按照約定向用人(ren)單位(wei)支付違約金(jin)。  

第(di)二十四條(tiao) 競(jing)(jing)(jing)業限(xian)(xian)制(zhi)的人(ren)員(yuan)限(xian)(xian)于用(yong)人(ren)單位的高級管(guan)理(li)人(ren)員(yuan)、高級技術人(ren)員(yuan)和其(qi)他負有保密義務的人(ren)員(yuan)。競(jing)(jing)(jing)業限(xian)(xian)制(zhi)的范(fan)圍(wei)、地域、期(qi)限(xian)(xian)由(you)用(yong)人(ren)單位與(yu)勞動者約定(ding),競(jing)(jing)(jing)業限(xian)(xian)制(zhi)的約定(ding)不得違(wei)反法(fa)律(lv)、法(fa)規的規定(ding)。  

在解除或者(zhe)終(zhong)止勞動(dong)合同后,前(qian)款規定(ding)的(de)(de)(de)(de)人員(yuan)到(dao)與本單位生(sheng)產(chan)(chan)或者(zhe)經營同類產(chan)(chan)品(pin)、從(cong)事同類業(ye)(ye)務(wu)(wu)的(de)(de)(de)(de)有競(jing)爭關系的(de)(de)(de)(de)其他用人單位,或者(zhe)自己開(kai)業(ye)(ye)生(sheng)產(chan)(chan)或者(zhe)經營同類產(chan)(chan)品(pin)、從(cong)事同類業(ye)(ye)務(wu)(wu)的(de)(de)(de)(de)競(jing)業(ye)(ye)限(xian)制期限(xian),不得超過二年。  

第二十(shi)五(wu)條 除本法第二十(shi)二條和(he)第二十(shi)三條規定的情形(xing)外,用人單(dan)位不得與(yu)勞(lao)動(dong)者(zhe)約定由勞(lao)動(dong)者(zhe)承擔違約金。  

第二十六條 下列勞(lao)動(dong)合同無(wu)效(xiao)或者(zhe)部分(fen)無(wu)效(xiao):  

(一)以欺詐、脅迫的手段(duan)或者乘人之危,使對方在違背真實(shi)意(yi)思的情況下(xia)訂立或者變更勞動合同的;  

(二)用人單位免(mian)除(chu)自己(ji)的(de)(de)法定責任、排除(chu)勞動者權利的(de)(de);  

(三)違反法(fa)律、行政(zheng)法(fa)規(gui)強制性規(gui)定的(de)。  

對勞動合同的無(wu)效或者(zhe)部分無(wu)效有爭議的,由勞動爭議仲裁機構或者(zhe)人(ren)民法院確(que)認。  

第二十七(qi)條 勞動合同部(bu)分(fen)(fen)(fen)無效(xiao)(xiao),不影響(xiang)其他部(bu)分(fen)(fen)(fen)效(xiao)(xiao)力的(de),其他部(bu)分(fen)(fen)(fen)仍然有(you)效(xiao)(xiao)。  

第二(er)十八條 勞(lao)動(dong)合(he)同(tong)被確(que)認無(wu)效,勞(lao)動(dong)者(zhe)已付(fu)出(chu)勞(lao)動(dong)的,用人單位(wei)應當向勞(lao)動(dong)者(zhe)支付(fu)勞(lao)動(dong)報(bao)酬(chou)。勞(lao)動(dong)報(bao)酬(chou)的數額,參照本單位(wei)相同(tong)或(huo)者(zhe)相近崗位(wei)勞(lao)動(dong)者(zhe)的勞(lao)動(dong)報(bao)酬(chou)確(que)定。  

第(di)三(san)章(zhang) 勞動合同(tong)的履(lv)(lv)行和變更  第(di)二十九(jiu)條 用人(ren)單位與(yu)勞動者應(ying)當按照勞動合同(tong)的約定,全面履(lv)(lv)行各自(zi)的義務(wu)。  

第(di)三十條(tiao) 用(yong)人單位應當(dang)按(an)照勞動合同約定和(he)國家規(gui)定,向勞動者及(ji)時足(zu)額(e)支(zhi)付勞動報酬。  

用人單(dan)位拖欠或者未足額支(zhi)付勞動報酬的(de),勞動者可以依(yi)法(fa)向當地人民法(fa)院申請支(zhi)付令(ling),人民法(fa)院應當依(yi)法(fa)發出(chu)支(zhi)付令(ling)。  

第三十一(yi)條(tiao) 用人(ren)單(dan)位(wei)應當嚴格執行(xing)勞(lao)動定額標準,不得強迫或(huo)者變(bian)相強迫勞(lao)動者加(jia)(jia)班(ban)(ban)。用人(ren)單(dan)位(wei)安排(pai)加(jia)(jia)班(ban)(ban)的,應當按照(zhao)國家有關規定向勞(lao)動者支付(fu)加(jia)(jia)班(ban)(ban)費。  

第三十二條(tiao) 勞(lao)動(dong)者拒絕(jue)用(yong)人單位管理人員違(wei)(wei)章指揮(hui)、強(qiang)令冒(mao)險(xian)作業的,不視(shi)為違(wei)(wei)反勞(lao)動(dong)合同。  

勞(lao)動(dong)者對(dui)(dui)危害生命安全和身體健康(kang)的勞(lao)動(dong)條件(jian),有權對(dui)(dui)用(yong)人單位(wei)提出批評、檢舉和控告。  

第三(san)十三(san)條 用人(ren)單位(wei)變更名稱、法定代表人(ren)、主(zhu)要(yao)負(fu)責人(ren)或者投資人(ren)等事項,不影響(xiang)勞動合同的履行(xing)。  

第三十四條 用人單位發(fa)生(sheng)合(he)并或者分立等情況,原勞(lao)動(dong)合(he)同(tong)繼(ji)續有效,勞(lao)動(dong)合(he)同(tong)由承繼(ji)其權利和(he)義務的用人單位繼(ji)續履行(xing)。  

第三十五條 用(yong)人單位與勞動(dong)(dong)者協商一致,可以變更(geng)勞動(dong)(dong)合(he)同約定的內容。變更(geng)勞動(dong)(dong)合(he)同,應當采用(yong)書面形式。  

變更后的勞動(dong)合同文(wen)本由用人(ren)單位和勞動(dong)者各執(zhi)一份。  

第四章-勞動合同的解除和終(zhong)止  

第三十六條 用人(ren)單位與勞動(dong)者(zhe)協商一(yi)致,可以解除勞動(dong)合同。  

第三十七(qi)條 勞(lao)動(dong)者提前(qian)三十日(ri)以書面形(xing)式通知(zhi)用人單(dan)(dan)位(wei),可以解除勞(lao)動(dong)合(he)同(tong)。勞(lao)動(dong)者在試用期內(nei)提前(qian)三日(ri)通知(zhi)用人單(dan)(dan)位(wei),可以解除勞(lao)動(dong)合(he)同(tong)。  

第三十八條 用人單位(wei)有(you)下(xia)列情形之一的(de),勞動(dong)者可(ke)以解除勞動(dong)合同:  

(一)未按照勞(lao)動(dong)(dong)合同約定提供勞(lao)動(dong)(dong)保護或者勞(lao)動(dong)(dong)條件的(de);  

(二)未及時足額(e)支付勞(lao)動報酬的;  

(三)未依法為勞動者繳納社會保險費(fei)的;  

(四)用人單位的規章制度違反法律、法規的規定,損害勞動者權益的;  

(五)因本(ben)法(fa)第二十(shi)六條第一款規(gui)定的情(qing)形致使勞動(dong)合(he)同(tong)無效(xiao)的;  

(六)法(fa)律、行政(zheng)法(fa)規規定勞動者可(ke)以解除(chu)勞動合同(tong)的其他情形(xing)。  

用人(ren)單位以暴力、威(wei)脅或者(zhe)(zhe)非(fei)法限制(zhi)人(ren)身自由的手段強迫勞動者(zhe)(zhe)勞動的,或者(zhe)(zhe)用人(ren)單位違(wei)章指(zhi)揮、強令冒險作業(ye)危及(ji)勞動者(zhe)(zhe)人(ren)身安全(quan)的,勞動者(zhe)(zhe)可以立即(ji)解除勞動合同,不需(xu)事先告知用人(ren)單位。  

第三十(shi)九條 勞(lao)動者有下(xia)列(lie)情(qing)形之一的,用人單位可以解(jie)除勞(lao)動合同:  

(一)在試用(yong)期間被(bei)證明(ming)不符合錄(lu)用(yong)條件的;  

(二)嚴重違反用人單位的規章制度的;  

(三)嚴重(zhong)失職,營私舞弊,給用人單位造成(cheng)重(zhong)大損害的;  

四(si))勞動(dong)者同(tong)時與(yu)其他(ta)用人單(dan)位建(jian)立勞動(dong)關系,對完成(cheng)本單(dan)位的工作(zuo)任務造(zao)成(cheng)嚴重影響,或者經用人單(dan)位提出,拒不改正(zheng)的;  

(五)因(yin)本法第(di)(di)二十(shi)六(liu)條第(di)(di)一(yi)款(kuan)第(di)(di)一(yi)項規定的(de)情形致使勞(lao)動合同無效(xiao)的(de);  

(六(liu))被依法(fa)追究刑事責(ze)任的。  

第四十(shi)條 有下列情(qing)形之一的,用人單位(wei)提(ti)前三(san)十(shi)日以(yi)書面形式通(tong)知勞(lao)動(dong)者本(ben)人或者額外(wai)支付勞(lao)動(dong)者一個月工(gong)資后,可以(yi)解除勞(lao)動(dong)合(he)同:  

(一)勞動(dong)者患病或者非因(yin)工負(fu)傷(shang),在規定的(de)醫療期滿后(hou)不(bu)能從事原(yuan)工作,也不(bu)能從事由用人單(dan)位(wei)另行安排(pai)的(de)工作的(de);  

(二)勞動者不能(neng)勝任工作,經過培訓或者調整(zheng)工作崗位,仍不能(neng)勝任工作的(de);  

(三)勞(lao)動(dong)(dong)合同訂立時所依(yi)據(ju)的客觀情況發生重大變化,致使勞(lao)動(dong)(dong)合同無法履行(xing),經用人單位與勞(lao)動(dong)(dong)者協(xie)(xie)商,未能就(jiu)變更勞(lao)動(dong)(dong)合同內容達成協(xie)(xie)議的。  

第四十一(yi)條(tiao) 有下(xia)列情形之一(yi),需要裁減人員(yuan)二(er)十人以(yi)上(shang)或者(zhe)裁減不足(zu)二(er)十人但(dan)占企業職工(gong)總數百分之十以(yi)上(shang)的(de),用人單位提前三十日向工(gong)會或者(zhe)全體職工(gong)說(shuo)明(ming)情況,聽取(qu)工(gong)會或者(zhe)職工(gong)的(de)意見后,裁減人員(yuan)方(fang)案(an)經向勞動行政部門報告,可(ke)以(yi)裁減人員(yuan):  

(一)依照企業破產法規定(ding)進行重整(zheng)的;  

(二)生產(chan)經營發生嚴重困難的;  

(三)企業轉產、重大(da)技術(shu)革新或者經營方式調整(zheng),經變更勞(lao)動合同(tong)后(hou),仍需裁(cai)減人員的;  

(四)其(qi)他因勞動合同訂立時所依據的(de)客(ke)觀經濟情況發生(sheng)重(zhong)大變(bian)化(hua),致使(shi)勞動合同無(wu)法履行的(de)。  

裁減人員(yuan)時,應當優先留用下列(lie)人員(yuan):  

(一)與本(ben)單位訂(ding)立(li)較長期限的固定(ding)期限勞動合同的;  

(二)與本單位訂立無固定(ding)期限(xian)勞動合同的;  

(三)家庭無(wu)其他(ta)就業人員,有需要(yao)撫養的(de)老人或者未成(cheng)年人的(de)。  

用人(ren)單(dan)位依照(zhao)本條(tiao)第一款規定(ding)裁減(jian)人(ren)員,在六個月內重新招(zhao)(zhao)用人(ren)員的(de),應當通知(zhi)被(bei)裁減(jian)的(de)人(ren)員,并(bing)在同等條(tiao)件下優先招(zhao)(zhao)用被(bei)裁減(jian)的(de)人(ren)員。  

第四十二條 勞動者有下(xia)列情形之一的,用人單位(wei)不得依照本法第四十條、第四十一條的規定解除勞動合同:  

(一)從事接觸(chu)職(zhi)業(ye)(ye)病(bing)(bing)危害作(zuo)業(ye)(ye)的(de)勞動者未(wei)進行離(li)崗前職(zhi)業(ye)(ye)健康檢查(cha),或(huo)(huo)者疑似(si)職(zhi)業(ye)(ye)病(bing)(bing)病(bing)(bing)人在診(zhen)斷(duan)或(huo)(huo)者醫學觀(guan)察期間(jian)的(de);  

(二)在本單位患職業病或者(zhe)因工(gong)負傷并被確認喪(sang)失或者(zhe)部分喪(sang)失勞動能力(li)的(de);  

(三(san))患(huan)病或(huo)者非因工負傷(shang),在規定的醫療期內(nei)的;  

(四)女職工在(zai)孕期、產(chan)期、哺(bu)乳期的;  

(五(wu))在本單(dan)位連續工作(zuo)滿十五(wu)年,且距(ju)法定(ding)退休年齡(ling)不足五(wu)年的(de);  

(六)法(fa)律、行政法(fa)規規定的(de)其他情形。  

第四十(shi)三條 用人(ren)單(dan)(dan)位單(dan)(dan)方解除勞動合(he)(he)同(tong),應(ying)當(dang)事先將理由通(tong)知(zhi)工(gong)會。用人(ren)單(dan)(dan)位違反法(fa)律、行政(zheng)法(fa)規(gui)(gui)規(gui)(gui)定或者勞動合(he)(he)同(tong)約定的,工(gong)會有(you)權要求(qiu)用人(ren)單(dan)(dan)位糾(jiu)正(zheng)。用人(ren)單(dan)(dan)位應(ying)當(dang)研究工(gong)會的意見(jian),并將處理結果書(shu)面通(tong)知(zhi)工(gong)會。  

第四十(shi)四條 有下列情形之一的(de),勞(lao)動(dong)合(he)同(tong)終止:  

(一(yi))勞動合(he)同期(qi)滿的;  

(二)勞(lao)動者開始(shi)依法(fa)享受基本養老保險待(dai)遇的;  

(三)勞動者(zhe)死(si)亡,或者(zhe)被人民法院宣告死(si)亡或者(zhe)宣告失蹤的(de);  

(四)用人(ren)單位被(bei)依(yi)法宣告破產(chan)的;  

(五)用人(ren)單位(wei)被吊銷(xiao)營業執照(zhao)、責令關閉(bi)、撤銷(xiao)或(huo)者用人(ren)單位(wei)決定提前解散的(de);  

(六)法(fa)律、行政法(fa)規規定的(de)其他情形。  

第四(si)十五條 勞動合同期滿,有本法第四(si)十二(er)(er)(er)條規定(ding)情形(xing)之(zhi)一的(de)(de)(de),勞動合同應當續延至相應的(de)(de)(de)情形(xing)消失時終止。但(dan)是,本法第四(si)十二(er)(er)(er)條第二(er)(er)(er)項規定(ding)喪(sang)失或者(zhe)部(bu)分喪(sang)失勞動能力勞動者(zhe)的(de)(de)(de)勞動合同的(de)(de)(de)終止,按(an)照國家有關工傷保(bao)險的(de)(de)(de)規定(ding)執行。  

第(di)四(si)十六(liu)條 有(you)下列情(qing)形之一的,用人(ren)單位應當向勞(lao)動者支(zhi)付經濟補償:  

(一)勞動者(zhe)依照本法(fa)第(di)三(san)十(shi)八條規定(ding)解(jie)除勞動合(he)同的;  

(二(er))用人(ren)單位依照本法第三(san)十(shi)六條規定向(xiang)勞動者提出解除(chu)勞動合同(tong)并與勞動者協商一致(zhi)解除(chu)勞動合同(tong)的;  

(三)用人單位依照本(ben)法(fa)第四(si)十條規定解除(chu)勞動合同的;  

(四)用人單位依照本法(fa)第(di)四十一(yi)條第(di)一(yi)款規(gui)定(ding)解除勞動合同的;  

(五)除用人(ren)單位(wei)維(wei)持或者提(ti)高勞(lao)動(dong)合(he)(he)同約定條件(jian)續訂勞(lao)動(dong)合(he)(he)同,勞(lao)動(dong)者不同意續訂的(de)情形外,依照本法第(di)四十四條第(di)一項規定終止固定期限勞(lao)動(dong)合(he)(he)同的(de);  

(六)依照本法第四十四條第四項、第五項規定終(zhong)止勞動合同的;  

(七)法律、行(xing)政(zheng)法規規定(ding)的其他情形。  

第四十七(qi)條 經濟補償按勞動者在(zai)本單(dan)位工(gong)作的年限(xian),每(mei)滿(man)(man)一年支(zhi)(zhi)付一個(ge)(ge)月(yue)工(gong)資(zi)的標準(zhun)向勞動者支(zhi)(zhi)付。六個(ge)(ge)月(yue)以上不滿(man)(man)一年的,按一年計算;不滿(man)(man)六個(ge)(ge)月(yue)的,向勞動者支(zhi)(zhi)付半個(ge)(ge)月(yue)工(gong)資(zi)的經濟補償。  

勞動(dong)者月(yue)工(gong)(gong)資(zi)(zi)高(gao)于用人單位所在(zai)直轄市(shi)、設區的(de)市(shi)級人民政府公(gong)布的(de)本地區上年度職(zhi)工(gong)(gong)月(yue)平均工(gong)(gong)資(zi)(zi)三倍的(de),向其(qi)支(zhi)付經濟補(bu)償的(de)標(biao)準(zhun)按(an)職(zhi)工(gong)(gong)月(yue)平均工(gong)(gong)資(zi)(zi)三倍的(de)數額(e)支(zhi)付,向其(qi)支(zhi)付經濟補(bu)償的(de)年限最高(gao)不超過十二年。  

本(ben)條所(suo)稱月工資是指勞動者在勞動合同(tong)解除或者終(zhong)止前十(shi)二個(ge)月的(de)平均工資。  

第四(si)十八(ba)條 用人(ren)單位違反本(ben)法規定(ding)解除(chu)或者(zhe)終(zhong)止勞動(dong)(dong)(dong)合同,勞動(dong)(dong)(dong)者(zhe)要(yao)求繼續履(lv)(lv)行(xing)(xing)勞動(dong)(dong)(dong)合同的,用人(ren)單位應當(dang)繼續履(lv)(lv)行(xing)(xing);勞動(dong)(dong)(dong)者(zhe)不要(yao)求繼續履(lv)(lv)行(xing)(xing)勞動(dong)(dong)(dong)合同或者(zhe)勞動(dong)(dong)(dong)合同已經不能繼續履(lv)(lv)行(xing)(xing)的,用人(ren)單位應當(dang)依照(zhao)本(ben)法第八(ba)十七條規定(ding)支付賠(pei)償金。  

第四十九條 國(guo)家(jia)采取措施,建(jian)立(li)健全(quan)勞(lao)動者社會保險關系跨(kua)地(di)區轉移接續制度(du)。  

第(di)五十條 用人單位(wei)應當在解(jie)除或者終止勞(lao)動(dong)(dong)合(he)(he)同(tong)時出(chu)具解(jie)除或者終止勞(lao)動(dong)(dong)合(he)(he)同(tong)的證明(ming),并(bing)在十五日(ri)內為勞(lao)動(dong)(dong)者辦理檔案和社會保險(xian)關系轉移手續(xu)。  

勞動者應當(dang)按照雙方約定,辦理工作交(jiao)接(jie)。用人單位(wei)依照本法有關規定應當(dang)向勞動者支(zhi)付(fu)經濟(ji)補償(chang)的,在(zai)辦結工作交(jiao)接(jie)時(shi)支(zhi)付(fu)。  

用人單位對已(yi)經解除或者終止的勞動合同的文本,至少保存二年備(bei)查。  

第五章(zhang) 特別規定(ding)  

第一節 集體合同  

第五十(shi)一條 企業職工一方與用人單位通(tong)過平等協商(shang),可以就勞(lao)(lao)動(dong)報(bao)酬、工作時間(jian)、休(xiu)息(xi)休(xiu)假、勞(lao)(lao)動(dong)安全衛生、保險福利等事項訂立集(ji)體合(he)同。集(ji)體合(he)同草案應(ying)當提交(jiao)職工代表(biao)大會(hui)或者(zhe)全體職工討論通(tong)過。  

集體合同由工會代表(biao)企業職工一方與用人(ren)單位訂立;尚未建立工會的(de)用人(ren)單位,由上級工會指導(dao)勞動者(zhe)推舉的(de)代表(biao)與用人(ren)單位訂立。  

第五十二條 企業職工(gong)一方與用人單位(wei)可以訂立(li)勞(lao)動安(an)全衛生(sheng)、女職工(gong)權益保護、工(gong)資調整(zheng)機制等專項(xiang)集體(ti)合同。  

第五(wu)十三條 在縣(xian)級以下(xia)區域(yu)內(nei),建筑業(ye)、采礦業(ye)、餐飲服(fu)務業(ye)等(deng)行業(ye)可(ke)以由工會與企(qi)業(ye)方面(mian)代表(biao)訂立行業(ye)性集體合同,或(huo)者訂立區域(yu)性集體合同。  

第(di)五十(shi)四條 集體合(he)同(tong)訂(ding)立后,應當報送勞動(dong)行政部(bu)(bu)門;勞動(dong)行政部(bu)(bu)門自收到集體合(he)同(tong)文本之日起十(shi)五日內未提出異(yi)議(yi)的,集體合(he)同(tong)即行生效(xiao)。  

依法訂(ding)立的(de)(de)集(ji)體合同對用人(ren)單(dan)(dan)位和(he)勞動(dong)者具(ju)有約(yue)束力。行(xing)(xing)業(ye)性、區域性集(ji)體合同對當地本(ben)(ben)行(xing)(xing)業(ye)、本(ben)(ben)區域的(de)(de)用人(ren)單(dan)(dan)位和(he)勞動(dong)者具(ju)有約(yue)束力。  

第五十五條 集體(ti)合(he)同(tong)中(zhong)(zhong)勞(lao)動報酬和勞(lao)動條件等標準(zhun)(zhun)不得(de)(de)低(di)于當地人民政(zheng)府規(gui)定的(de)最(zui)低(di)標準(zhun)(zhun);用人單(dan)位與勞(lao)動者訂立的(de)勞(lao)動合(he)同(tong)中(zhong)(zhong)勞(lao)動報酬和勞(lao)動條件等標準(zhun)(zhun)不得(de)(de)低(di)于集體(ti)合(he)同(tong)規(gui)定的(de)標準(zhun)(zhun)。  

第(di)五十六條 用人(ren)單位違反集體合同(tong),侵(qin)犯職工勞動權益(yi)的(de)(de),工會(hui)可以依法(fa)要求用人(ren)單位承擔責任(ren);因(yin)履行集體合同(tong)發生爭議,經(jing)協商解(jie)決不成的(de)(de),工會(hui)可以依法(fa)申請(qing)仲裁、提(ti)起訴訟。

第二節(jie) 勞務派遣  

第五十七條(tiao) 經營勞(lao)務(wu)派遣業(ye)務(wu)應當(dang)具備(bei)下列條(tiao)件:   

“(一(yi))注冊(ce)資本不(bu)得(de)少于(yu)人(ren)民幣(bi)二百萬元(yuan);  

“(二)有與開展業務相適(shi)應的(de)固定的(de)經營場所和設施; 

“(三(san))有符合法(fa)律、行(xing)政法(fa)規(gui)規(gui)定的勞務派遣管理(li)制(zhi)度;  

“(四)法(fa)律(lv)、行政法(fa)規規定的其他(ta)條件。 

“經(jing)營(ying)勞(lao)(lao)務(wu)(wu)派(pai)遣業務(wu)(wu),應(ying)當向(xiang)勞(lao)(lao)動行(xing)政(zheng)部門依法(fa)申請行(xing)政(zheng)許(xu)(xu)可(ke);經(jing)許(xu)(xu)可(ke)的,依法(fa)辦理相應(ying)的公(gong)司登(deng)記。未(wei)經(jing)許(xu)(xu)可(ke),任何單位和(he)個人不得經(jing)營(ying)勞(lao)(lao)務(wu)(wu)派(pai)遣業務(wu)(wu)。”  

第五十八條 勞(lao)務(wu)派(pai)遣(qian)(qian)單(dan)(dan)位(wei)(wei)是本法所稱用(yong)人單(dan)(dan)位(wei)(wei),應當(dang)履行用(yong)人單(dan)(dan)位(wei)(wei)對(dui)勞(lao)動(dong)(dong)者(zhe)的義務(wu)。勞(lao)務(wu)派(pai)遣(qian)(qian)單(dan)(dan)位(wei)(wei)與(yu)被(bei)派(pai)遣(qian)(qian)勞(lao)動(dong)(dong)者(zhe)訂立的勞(lao)動(dong)(dong)合同,除應當(dang)載(zai)明本法第十七條規(gui)定的事項外,還應當(dang)載(zai)明被(bei)派(pai)遣(qian)(qian)勞(lao)動(dong)(dong)者(zhe)的用(yong)工單(dan)(dan)位(wei)(wei)以及派(pai)遣(qian)(qian)期(qi)限(xian)、工作崗位(wei)(wei)等情況。  

勞(lao)(lao)務(wu)派遣單位應(ying)當與被派遣勞(lao)(lao)動者訂立二年(nian)以上(shang)的固(gu)定期限勞(lao)(lao)動合同,按(an)月支付勞(lao)(lao)動報(bao)(bao)酬(chou);被派遣勞(lao)(lao)動者在(zai)無工(gong)作期間,勞(lao)(lao)務(wu)派遣單位應(ying)當按(an)照所在(zai)地人民政府規定的最低工(gong)資(zi)標準,向其(qi)按(an)月支付報(bao)(bao)酬(chou)。  

第五十九(jiu)條 勞(lao)(lao)務(wu)派(pai)(pai)遣單位(wei)(wei)派(pai)(pai)遣勞(lao)(lao)動者應(ying)當與(yu)接受(shou)以勞(lao)(lao)務(wu)派(pai)(pai)遣形式用(yong)工(gong)的單位(wei)(wei)(以下稱用(yong)工(gong)單位(wei)(wei))訂立勞(lao)(lao)務(wu)派(pai)(pai)遣協議(yi)。勞(lao)(lao)務(wu)派(pai)(pai)遣協議(yi)應(ying)當約定派(pai)(pai)遣崗位(wei)(wei)和人員(yuan)數(shu)量、派(pai)(pai)遣期限、勞(lao)(lao)動報酬和社會保(bao)險費的數(shu)額與(yu)支(zhi)付(fu)方式以及違反協議(yi)的責任。  

用(yong)工(gong)單(dan)位應當根據工(gong)作崗位的實際需要與勞務(wu)派(pai)遣(qian)單(dan)位確定(ding)派(pai)遣(qian)期限,不得將連續(xu)用(yong)工(gong)期限分(fen)割訂(ding)立數個短期勞務(wu)派(pai)遣(qian)協議(yi)。  

第六(liu)十條 勞務(wu)派(pai)遣(qian)單(dan)位應當將勞務(wu)派(pai)遣(qian)協議的內(nei)容(rong)告知被派(pai)遣(qian)勞動者。  

勞務派遣(qian)(qian)單位不得克扣用(yong)工單位按照勞務派遣(qian)(qian)協議支(zhi)付給被派遣(qian)(qian)勞動者(zhe)的(de)勞動報酬。  

勞務派(pai)遣(qian)單位和(he)用工單位不(bu)得(de)向被派(pai)遣(qian)勞動(dong)者收取費用。  

第六十一(yi)條 勞(lao)(lao)務(wu)派遣(qian)單位跨地(di)區(qu)派遣(qian)勞(lao)(lao)動者的(de),被派遣(qian)勞(lao)(lao)動者享有的(de)勞(lao)(lao)動報酬和勞(lao)(lao)動條件(jian),按照用(yong)工單位所在地(di)的(de)標(biao)準執行。  

第六十(shi)二條 用工單(dan)位應當履行下列義務:  

(一)執行國家勞動標準,提供相應的勞動條件和勞動保護(hu);  

(二)告知(zhi)被派遣勞動(dong)者的(de)工作要(yao)求和(he)勞動(dong)報酬  

(三)支付加班(ban)費、績效(xiao)獎(jiang)金,提(ti)供與工作崗位相關的(de)福利待遇;  

(四)對在崗被(bei)派遣(qian)勞動者(zhe)進行工作崗位(wei)所必需的培訓  

(五)連續用工的(de)(de),實行正常的(de)(de)工資(zi)調整(zheng)機制。  用工單位(wei)不得將被派遣勞動(dong)者再派遣到其他用人(ren)單位(wei)。  

第六十三(san)條(tiao) 被派(pai)遣勞(lao)動(dong)者(zhe)(zhe)享(xiang)有與(yu)用(yong)工單(dan)位(wei)(wei)被派(pai)遣勞(lao)動(dong)者(zhe)(zhe)享(xiang)有與(yu)用(yong)工單(dan)位(wei)(wei)的勞(lao)動(dong)者(zhe)(zhe)同(tong)(tong)工同(tong)(tong)酬的權(quan)利。用(yong)工單(dan)位(wei)(wei)應當按照同(tong)(tong)工同(tong)(tong)酬原則,對(dui)被派(pai)遣勞(lao)動(dong)者(zhe)(zhe)與(yu)本單(dan)位(wei)(wei)同(tong)(tong)類崗(gang)(gang)位(wei)(wei)的勞(lao)動(dong)者(zhe)(zhe)實行相同(tong)(tong)的勞(lao)動(dong)報酬分配辦法(fa)。用(yong)工單(dan)位(wei)(wei)無同(tong)(tong)類崗(gang)(gang)位(wei)(wei)勞(lao)動(dong)者(zhe)(zhe)的,參(can)照用(yong)工單(dan)位(wei)(wei)所在地(di)相同(tong)(tong)或者(zhe)(zhe)相近崗(gang)(gang)位(wei)(wei)勞(lao)動(dong)者(zhe)(zhe)的勞(lao)動(dong)報酬確定。  

“勞(lao)(lao)務(wu)派遣單位與被派遣勞(lao)(lao)動者(zhe)訂(ding)(ding)立的(de)勞(lao)(lao)動合同(tong)和與用工單位訂(ding)(ding)立的(de)勞(lao)(lao)務(wu)派遣協議,載明或(huo)者(zhe)約(yue)定的(de)向被派遣勞(lao)(lao)動者(zhe)支付(fu)的(de)勞(lao)(lao)動報酬應當符(fu)合前款規定。”。  

第六十(shi)四條 被派(pai)遣(qian)勞動者(zhe)有權(quan)在勞務派(pai)遣(qian)單位或者(zhe)用工(gong)單位依法參(can)加(jia)或者(zhe)組織工(gong)會,維護(hu)自身(shen)的合法權(quan)益(yi)。  

第(di)(di)(di)六十(shi)五(wu)條(tiao)(tiao) 被派遣勞(lao)動者可(ke)以依照本法第(di)(di)(di)三十(shi)六條(tiao)(tiao)、第(di)(di)(di)三十(shi)八(ba)條(tiao)(tiao)的規定與勞(lao)務派遣單位解除勞(lao)動合同。  

被派(pai)遣勞動者有(you)本(ben)法第(di)三十九條和第(di)四十條第(di)一項、第(di)二項規定(ding)(ding)情形的,用工單(dan)位可(ke)以將勞動者退回(hui)勞務(wu)派(pai)遣單(dan)位,勞務(wu)派(pai)遣單(dan)位依照(zhao)本(ben)法有(you)關規定(ding)(ding),可(ke)以與(yu)勞動者解除勞動合同。  

第六(liu)十(shi)六(liu)條(tiao) 勞(lao)動合(he)同用(yong)工是我國的(de)企業基(ji)本用(yong)工形式(shi)。勞(lao)務派遣(qian)用(yong)工是補(bu)充形式(shi),只能在臨(lin)時(shi)性、輔助性或者替代性的(de)工作(zuo)崗位上實(shi)施(shi)。  

“前款規(gui)定(ding)的(de)臨時性工作(zuo)(zuo)崗(gang)位(wei)是指(zhi)存續時間不超(chao)過六個月(yue)的(de)崗(gang)位(wei);輔助性工作(zuo)(zuo)崗(gang)位(wei)是指(zhi)為主營業(ye)務(wu)崗(gang)位(wei)提(ti)供服務(wu)的(de)非主營業(ye)務(wu)崗(gang)位(wei);替(ti)代(dai)性工作(zuo)(zuo)崗(gang)位(wei)是指(zhi)用工單位(wei)的(de)勞動者因脫產學(xue)習、休假(jia)等原(yuan)因無法工作(zuo)(zuo)的(de)一(yi)定(ding)期間內,可以由其他勞動者替(ti)代(dai)工作(zuo)(zuo)的(de)崗(gang)位(wei)。  

“用(yong)工單(dan)位應當嚴格控制勞(lao)務派遣用(yong)工數量,不得超過其用(yong)工總量的一(yi)定比例,具體比例由國務院勞(lao)動行政部門規定。”。  

第(di)六十七條(tiao) 用(yong)人單位(wei)不(bu)得設立勞務派遣單位(wei)向本單位(wei)或(huo)者所屬(shu)單位(wei)派遣勞動者。第(di)三節(jie) 非全日制用(yong)工  

第六十(shi)八條 非全日制用工,是(shi)指以小時(shi)(shi)計酬(chou)為主,勞動者在同一用人單位一般平(ping)均每日工作(zuo)時(shi)(shi)間不超(chao)過四(si)小時(shi)(shi),每周(zhou)工作(zuo)時(shi)(shi)間累計不超(chao)過二十(shi)四(si)小時(shi)(shi)的用工形式。  

第(di)六十九條 非全日(ri)制(zhi)用工雙方(fang)當事人(ren)可(ke)以訂立(li)口頭協議。  

從事(shi)非全日制(zhi)用工的(de)(de)勞(lao)動者可以(yi)與一個(ge)或(huo)者一個(ge)以(yi)上用人單位(wei)訂(ding)立勞(lao)動合(he)(he)同(tong);但是,后訂(ding)立的(de)(de)勞(lao)動合(he)(he)同(tong)不得影響先訂(ding)立的(de)(de)勞(lao)動合(he)(he)同(tong)的(de)(de)履行(xing)。  

第七十條 非全日制用工雙方當事人不得約(yue)定試(shi)用期。  

第七十(shi)一條(tiao) 非(fei)全日制用(yong)(yong)工雙方當事(shi)人任何一方都可以隨時(shi)通知對(dui)方終止(zhi)用(yong)(yong)工。終止(zhi)用(yong)(yong)工,用(yong)(yong)人單位(wei)不向勞(lao)動者支付(fu)經濟補償。  

第七十二(er)條(tiao) 非全日制用(yong)工(gong)小時(shi)(shi)計酬(chou)標準不得低(di)于用(yong)人單位(wei)所在地人民(min)政府規定(ding)的最低(di)小時(shi)(shi)工(gong)資標準。  

非全日制用工勞動報酬結算支付周期(qi)最長不得超過(guo)十五日。  

第六(liu)章 監督檢查  

第(di)七十三條 國務院勞動行政部門負責(ze)全國勞動合同制度實(shi)施的(de)監(jian)督管理(li)。  

縣級(ji)以上地(di)方人民政(zheng)府勞動(dong)(dong)行政(zheng)部門負責(ze)本行政(zheng)區(qu)域內勞動(dong)(dong)合同制度實施的監督管理。  

縣級以(yi)上各級人民政(zheng)府勞動行(xing)(xing)政(zheng)部(bu)門在勞動合同制度(du)實施(shi)的(de)監督管(guan)理工作中(zhong),應(ying)當聽取工會、企業方面代表(biao)以(yi)及有關行(xing)(xing)業主(zhu)管(guan)部(bu)門的(de)意見。  

第七十四條 縣級以(yi)上地方(fang)人民政府(fu)勞動行政部門依法對下列實施勞動合(he)同制(zhi)度的情況進(jin)行監督(du)檢(jian)查:  

(一)用人單位(wei)制(zhi)定直接涉及(ji)勞動者(zhe)切(qie)身利益的規章制(zhi)度及(ji)其執行的情況  

(二)用人單位(wei)與勞(lao)(lao)動者(zhe)訂立和解除勞(lao)(lao)動合同的情況;  

(三(san))勞(lao)務(wu)派遣單位和用工單位遵守勞(lao)務(wu)派遣有關規定(ding)的情(qing)況  

(四(si))用人(ren)單(dan)位遵守國家關于(yu)勞動(dong)者(zhe)工作時間和休息休假規定的情況;  

(五)用(yong)人單位支付勞(lao)動合同約定(ding)的勞(lao)動報酬(chou)和執行最(zui)低工資標準的情況  

(六)用人(ren)單位參(can)加各項社會保(bao)險(xian)和(he)繳納社會保(bao)險(xian)費的情(qing)況;  

(七)法律、法規規定的其他勞動監察事項(xiang)。  

第七十五條 縣級(ji)以上地方人民政(zheng)(zheng)府勞(lao)動(dong)(dong)行(xing)政(zheng)(zheng)部(bu)門實施監督檢查時,有權查閱與(yu)勞(lao)動(dong)(dong)合同、集體合同有關的材料,有權對勞(lao)動(dong)(dong)場(chang)所進(jin)行(xing)實地檢查,用人單位和(he)勞(lao)動(dong)(dong)者(zhe)都應當如實提供(gong)有關情況(kuang)和(he)材料。  勞(lao)動(dong)(dong)行(xing)政(zheng)(zheng)部(bu)門的工作(zuo)人員(yuan)進(jin)行(xing)監督檢查,應當出示證件,依(yi)法行(xing)使職(zhi)權,文明執法。  

第七十六條 縣級以上人民政府建設、衛生、安全生產監(jian)督管(guan)(guan)理等有關主管(guan)(guan)部門在各(ge)自職責范圍內(nei),對(dui)用人單位執行勞(lao)動合同制度的(de)情(qing)況進行監(jian)督管(guan)(guan)理。  

第七十七條 勞動(dong)者(zhe)合(he)法(fa)(fa)(fa)權益(yi)受到(dao)侵害的,有(you)權要求(qiu)有(you)關部門(men)依(yi)法(fa)(fa)(fa)處(chu)理,或者(zhe)依(yi)法(fa)(fa)(fa)申請(qing)仲裁、提起訴訟。  

第七十(shi)八(ba)條(tiao) 工(gong)會(hui)依法維護(hu)勞(lao)動(dong)者的(de)合(he)法權益,對用(yong)人單位(wei)(wei)履行(xing)勞(lao)動(dong)合(he)同(tong)、集體(ti)合(he)同(tong)的(de)情況進行(xing)監督。用(yong)人單位(wei)(wei)違反勞(lao)動(dong)法律、法規(gui)和(he)勞(lao)動(dong)合(he)同(tong)、集體(ti)合(he)同(tong)的(de),工(gong)會(hui)有權提出意見或(huo)者要求糾正(zheng);勞(lao)動(dong)者申請仲裁(cai)、提起(qi)訴(su)訟的(de),工(gong)會(hui)依法給予支持(chi)和(he)幫(bang)助。  

第七(qi)十九條 任何組織或(huo)者個人對(dui)違反(fan)本法的行為都有權舉(ju)報(bao)(bao),縣級以上(shang)人民政府勞(lao)動行政部門(men)應(ying)當及時核實(shi)、處理,并對(dui)舉(ju)報(bao)(bao)有功人員(yuan)給予獎勵。  

第七(qi)章(zhang) 法律責任  

第八十條 用人單位直接涉及勞動者切身利(li)益的規(gui)章制(zhi)度違(wei)反法(fa)律、法(fa)規(gui)規(gui)定的,由勞動行(xing)政(zheng)部(bu)門責令改正,給予警告(gao);給勞動者造成損(sun)害的,應當承擔賠(pei)償責任。  

第八十一(yi)條 用人(ren)單(dan)位(wei)提供(gong)的(de)勞(lao)(lao)動合(he)同文本未(wei)載明(ming)本法規定(ding)的(de)勞(lao)(lao)動合(he)同必備條款或者(zhe)用人(ren)單(dan)位(wei)未(wei)將勞(lao)(lao)動合(he)同文本交(jiao)付(fu)勞(lao)(lao)動者(zhe)的(de),由勞(lao)(lao)動行政部門責(ze)令改正;給勞(lao)(lao)動者(zhe)造成損害的(de),應(ying)當承擔賠償責(ze)任。  

第八十二條 用(yong)(yong)人(ren)單位自用(yong)(yong)工之日起(qi)超過一個(ge)月(yue)不滿(man)一年未與(yu)勞動(dong)者(zhe)訂立書面勞動(dong)合(he)同的,應當向勞動(dong)者(zhe)每月(yue)支(zhi)付二倍的工資。  

用人單位違反本法規定不(bu)與(yu)勞動(dong)者(zhe)訂(ding)立(li)無固(gu)定期限(xian)勞動(dong)合同(tong)的,自應當訂(ding)立(li)無固(gu)定期限(xian)勞動(dong)合同(tong)之日起向勞動(dong)者(zhe)每(mei)月支(zhi)付二倍的工資。  

第八十三條 用(yong)(yong)人(ren)單(dan)(dan)位(wei)違反本法(fa)規定與勞動者約定試(shi)用(yong)(yong)期的(de),由勞動行政部(bu)門責令改(gai)正;違法(fa)約定的(de)試(shi)用(yong)(yong)期已經履行的(de),由用(yong)(yong)人(ren)單(dan)(dan)位(wei)以勞動者試(shi)用(yong)(yong)期滿月工資為(wei)標準,按已經履行的(de)超(chao)過法(fa)定試(shi)用(yong)(yong)期的(de)期間向(xiang)勞動者支付賠(pei)償金(jin)。  

第八十四條 用人單(dan)位違反本(ben)法規定(ding),扣(kou)押勞(lao)動者居民身份證(zheng)等證(zheng)件的,由勞(lao)動行政部門責令限期(qi)退還勞(lao)動者本(ben)人,并依照有關法律(lv)規定(ding)給(gei)予處罰。  

用人單位(wei)違(wei)反本(ben)法規定,以(yi)(yi)擔(dan)(dan)保(bao)或者(zhe)其他名義(yi)向勞動(dong)(dong)(dong)者(zhe)收(shou)取財物(wu)的,由勞動(dong)(dong)(dong)行政部(bu)門責令(ling)限期(qi)退還(huan)勞動(dong)(dong)(dong)者(zhe)本(ben)人,并以(yi)(yi)每人五百元以(yi)(yi)上二(er)千元以(yi)(yi)下的標準處以(yi)(yi)罰款;給勞動(dong)(dong)(dong)者(zhe)造成損害的,應當承擔(dan)(dan)賠(pei)償責任。  

勞動者依法解除或者終止勞動合(he)同,用人單位扣押勞動者檔案或者其他物品(pin)的,依照(zhao)前(qian)款(kuan)規定(ding)處罰。  

第八十五條(tiao) 用人單(dan)位有下列情形之(zhi)一(yi)的(de)(de),由勞動(dong)(dong)行(xing)政部門責令限(xian)期(qi)支(zhi)付勞動(dong)(dong)報酬、加班費(fei)或者(zhe)經(jing)濟(ji)補償(chang)(chang);勞動(dong)(dong)報酬低(di)于當(dang)地(di)最低(di)工(gong)資標準的(de)(de),應(ying)當(dang)支(zhi)付其差額(e)部分(fen);逾期(qi)不(bu)支(zhi)付的(de)(de),責令用人單(dan)位按應(ying)付金額(e)百分(fen)之(zhi)五十以(yi)上百分(fen)之(zhi)一(yi)百以(yi)下的(de)(de)標準向勞動(dong)(dong)者(zhe)加付賠償(chang)(chang)金:  

(一)未按照勞動(dong)合同的(de)約定或者(zhe)國家規(gui)定及時足額支付(fu)勞動(dong)者(zhe)勞動(dong)報(bao)酬的(de);  

(二)低于當地最低工資標準支付勞(lao)動(dong)者工資的  

三(san))安(an)排(pai)加班(ban)(ban)不(bu)支付加班(ban)(ban)費的;  

(四)解除(chu)或者(zhe)終止勞動合同,未依照本法規定向勞動者(zhe)支(zhi)付經濟補償的。  

第八十六條(tiao) 勞動合同依照本法第二十六條(tiao)規(gui)定被確認無效,給對方造成損害(hai)的,有過錯的一方應當承擔賠(pei)償責任。  

第(di)八十(shi)(shi)七條 用(yong)人單(dan)位違反(fan)本法規定解除(chu)或者終止(zhi)勞(lao)動合同的,應當依照本法第(di)四十(shi)(shi)七條規定的經濟補償標(biao)準的二倍向勞(lao)動者支付賠償金(jin)。  

第八(ba)(ba)十八(ba)(ba)條 用人單位有下列情形之一(yi)的,依法給予行政(zheng)處罰;構成犯罪的,依法追究刑(xing)事責(ze)任;給勞(lao)動者造成損(sun)害(hai)的,應當承擔(dan)賠償責(ze)任:  

(一)以暴力、威脅或者非法限制(zhi)人身自(zi)由的(de)手段強迫勞(lao)動的(de)  

(二)違章指揮或者(zhe)(zhe)強(qiang)令(ling)冒險作業危(wei)及勞動(dong)者(zhe)(zhe)人身安全(quan)的;  

(三)侮辱、體(ti)罰、毆打、非法搜(sou)查或者(zhe)拘禁(jin)勞動(dong)者(zhe)的  

(四)勞(lao)動(dong)條件惡(e)劣、環境污染嚴(yan)重,給勞(lao)動(dong)者(zhe)身心健康造成嚴(yan)重損(sun)害的(de)。  

第(di)八十九條 用人(ren)單位違(wei)反(fan)本法規(gui)定未向勞(lao)(lao)(lao)動(dong)者(zhe)出(chu)具解(jie)除或者(zhe)終止勞(lao)(lao)(lao)動(dong)合同的書(shu)面證明,由勞(lao)(lao)(lao)動(dong)行政(zheng)部門(men)責令改正;給勞(lao)(lao)(lao)動(dong)者(zhe)造成損(sun)害的,應當(dang)承擔賠償責任。  

第九十條 勞(lao)(lao)動者(zhe)違(wei)反(fan)本法規(gui)定(ding)解除勞(lao)(lao)動合同(tong),或者(zhe)違(wei)反(fan)勞(lao)(lao)動合同(tong)中約定(ding)的(de)保密義務或者(zhe)競業限制(zhi),給用人單(dan)位造成(cheng)損失的(de),應當承擔賠(pei)償(chang)責任(ren)。  

第九十一條 用人單位招用與其他用人單位尚未解除或者(zhe)終止勞(lao)動合(he)同(tong)的勞(lao)動者(zhe),給其他用人單位造成(cheng)損失的,應當承擔(dan)連帶賠償責任。  

第九(jiu)十二條 違(wei)(wei)反本法(fa)規定,未(wei)經許(xu)可,擅(shan)自(zi)經營勞(lao)務派(pai)遣業務的(de)(de),由勞(lao)動行(xing)(xing)政(zheng)部門(men)責(ze)令停止(zhi)違(wei)(wei)法(fa)行(xing)(xing)為,沒收違(wei)(wei)法(fa)所(suo)得(de)(de),并處違(wei)(wei)法(fa)所(suo)得(de)(de)一倍(bei)以(yi)上五(wu)倍(bei)以(yi)下的(de)(de)罰(fa)款;沒有違(wei)(wei)法(fa)所(suo)得(de)(de)的(de)(de),可以(yi)處五(wu)萬(wan)元以(yi)下的(de)(de)罰(fa)款。  

“勞務(wu)(wu)派遣(qian)(qian)(qian)單(dan)(dan)(dan)位(wei)、用工(gong)(gong)單(dan)(dan)(dan)位(wei)違(wei)反本法有關勞務(wu)(wu)派遣(qian)(qian)(qian)規定的(de),由勞動行政(zheng)部門責(ze)令(ling)限(xian)期改正(zheng);逾期不改正(zheng)的(de),以每人五千元以上(shang)一萬元以下的(de)標(biao)準處以罰款,對勞務(wu)(wu)派遣(qian)(qian)(qian)單(dan)(dan)(dan)位(wei),吊(diao)銷其勞務(wu)(wu)派遣(qian)(qian)(qian)業務(wu)(wu)經營許可(ke)證。用工(gong)(gong)單(dan)(dan)(dan)位(wei)給(gei)被派遣(qian)(qian)(qian)勞動者造成損(sun)害(hai)的(de),勞務(wu)(wu)派遣(qian)(qian)(qian)單(dan)(dan)(dan)位(wei)與(yu)用工(gong)(gong)單(dan)(dan)(dan)位(wei)承擔(dan)連帶賠(pei)償(chang)責(ze)任。”[4]。  

第九十三條 對不(bu)具備合法(fa)(fa)經(jing)營資(zi)格的(de)用人單(dan)位(wei)的(de)違法(fa)(fa)犯罪行為,依(yi)(yi)法(fa)(fa)追究法(fa)(fa)律(lv)責(ze)任;勞動(dong)者(zhe)(zhe)已經(jing)付出(chu)勞動(dong)的(de),該單(dan)位(wei)或者(zhe)(zhe)其(qi)出(chu)資(zi)人應當依(yi)(yi)照本法(fa)(fa)有關規(gui)定向(xiang)勞動(dong)者(zhe)(zhe)支付勞動(dong)報酬、經(jing)濟補償、賠償金;給勞動(dong)者(zhe)(zhe)造成損害的(de),應當承擔賠償責(ze)任。  

第九十四條 個(ge)人承包經營違反本法規定招(zhao)用勞(lao)動(dong)者,給(gei)勞(lao)動(dong)者造成損害的,發包的組織與(yu)個(ge)人承包經營者承擔連帶賠(pei)償(chang)責任。  

第九十(shi)五條 勞(lao)動行政(zheng)部(bu)門(men)和其(qi)他(ta)有(you)關主管部(bu)門(men)及其(qi)工(gong)作人員(yuan)玩忽職(zhi)守(shou)、不履行法(fa)(fa)定職(zhi)責,或者違法(fa)(fa)行使職(zhi)權,給勞(lao)動者或者用人單位造成損害(hai)的(de),應當承擔(dan)賠償責任(ren);對(dui)直(zhi)接負責的(de)主管人員(yuan)和其(qi)他(ta)直(zhi)接責任(ren)人員(yuan),依(yi)法(fa)(fa)給予(yu)行政(zheng)處(chu)分(fen);構成犯罪(zui)的(de),依(yi)法(fa)(fa)追究(jiu)刑事責任(ren)。  

第八章 附則(ze)  

第九十六(liu)條 事業單位與(yu)實行聘用制的(de)工作人(ren)員訂立、履行、變更、解除(chu)或者終止(zhi)勞動合同,法律、行政(zheng)法規或者國務院(yuan)另有規定的(de),依(yi)照(zhao)其規定;未(wei)作規定的(de),依(yi)照(zhao)本法有關(guan)規定執行。  

第九十七(qi)條 本法(fa)施(shi)行前已依法(fa)訂(ding)立且在(zai)本法(fa)施(shi)行之日存續的勞(lao)動(dong)(dong)合(he)同,繼續履行;本法(fa)第十四條第二款第三項(xiang)規定(ding)連續訂(ding)立固定(ding)期(qi)限勞(lao)動(dong)(dong)合(he)同的次數,自本法(fa)施(shi)行后續訂(ding)固定(ding)期(qi)限勞(lao)動(dong)(dong)合(he)同時開始(shi)計算。  

本法施(shi)行前(qian)已建(jian)立勞動關(guan)系,尚未訂(ding)立書(shu)面勞動合同的,應當自本法施(shi)行之日起一(yi)個(ge)月內(nei)訂(ding)立。  

本法(fa)施(shi)行(xing)之日(ri)(ri)存續的(de)勞(lao)動(dong)(dong)合同(tong)(tong)在本法(fa)施(shi)行(xing)后解除或者終(zhong)止,依(yi)照本法(fa)第(di)(di)四十六條規定(ding)應(ying)(ying)當(dang)支付經(jing)濟補償(chang)的(de),經(jing)濟補償(chang)年(nian)限自(zi)(zi)本法(fa)施(shi)行(xing)之日(ri)(ri)起計算;本法(fa)施(shi)行(xing)前按(an)照當(dang)時有(you)關(guan)規定(ding),用人(ren)單(dan)位(wei)應(ying)(ying)當(dang)向勞(lao)動(dong)(dong)者支付經(jing)濟補償(chang)的(de),按(an)照當(dang)時有(you)關(guan)規定(ding)執行(xing)。第(di)(di)九十八條 本法(fa)自(zi)(zi)2008年(nian)1月1日(ri)(ri)起施(shi)行(xing)。-說明:經(jing)過全國人(ren)民代表大(da)會(hui)常(chang)務委員會(hui)于2012年(nian)12月28日(ri)(ri)通過第(di)(di)一次修正(zheng)后的(de)《中華(hua)人(ren)民共和國勞(lao)動(dong)(dong)合同(tong)(tong)法(fa)<2013年(nian)新修正(zheng)版>》自(zi)(zi)2013年(nian)7月1日(ri)(ri)起施(shi)行(xing)。
